Report on existing pay equity laws and recs on amending County contracting policy
This is the second in a series of report-backs provided by the County Counsel and the Office of the County Executive in response to the Board of Supervisors’ September 15, 2015 directives for more information. One of those directives was to assess current County policies and practices related to hiring, pay, and promotion and their implications for gender, racial/ethnic, and sexual orientation equity. Direction on whether to pursue controversial Opt-in/Stay in Business concept that could relax rent control for mobilehome parks; approving policy to assist displaced mobilehome residents
As recommended by the Planning Commission, Council may adopt a resolution to amend Title 20 of the San Jose Municipal Code to make City Council the decision making body for consideration of all proposed mobilehome park conversions to another use after the Planning Commission considers these proposals for recommendations to Council, and add provisions for making findings of consistency with the Envision San Jose 2040 General Plan for Conditional Use Permits.
The General Plan Text Amendment relating to Mobilehome Park Protection strengthens the goals and policies to protect existing mobilehome parks and adding General Plan goals, policies, and actions to preserve mobilehome parks and other housing in each Urban Village until the preservation of affordable housing can be comprehensively addressed by the adoption of an Urban Village Plan specific to that Urban Village.

Direction on new Downtown Strategy & EIR
The fundamental purpose of updating the Downtown Strategy is to update the land use plan and identify necessary traffic improvements to support anticipated levels of Downtown development. The answers to two key questions are essential for informing related policy decisions:
- What transportation improvements are required (or desirable) to support planned new development?
- How will those transportation improvements be funded?
A NOP of a Draft EIR was circulated on October 6, 2015 (http://www.sanjoseca.gov/DocumentCenter/View/46911). Written comments were received from: CA Department of Transportation, PG&E, Preservation Action Council of San Jose, San Jose Downtown Association, Santa Clara Valley Water District, SPUR, Valley Transportation Agency.
The next steps are to complete the traffic impact analysis and then finalize the project description. A nexus study will be prepared if a Traffic Impact Fee is proposed to fund identified traffic impact mitigation measures. The Draft EIR is scheduled for public review and comment in October 2016.

Next steps for 4-Yr Review of General Plan; rec to reduce planned job capacity from 470K to 362K jobs
The Four-Year Review process, which began in Nov. 2015, provides an opportunity to make mid-course adjustments to the General Plan. The approved scope of work included items outlined in the attached Scope of Envision San Jose 2040 4-Year Review, items outlined in the April 10, 2015, memorandum from the Mayor and Councilmembers Jones and Carrasco, as well as items 2 through 8 outlined in the April 10, 2015, memorandum from Councilmembers Rocha and Peralez.
The General Plan Four-Year Review includes updated projections of jobs, population, and employed residents. As a follow up to the updated jobs projections, an employment lands market analysis was conducted. The key findings of the analysis include:

Direction on North San Jose development policy & new EIR
The committee may accept or provide direction on updating the North San Jose Area Development Policy & EIR and forward to the full City Council for approval on March 8.
North San Jose is the City’s largest employment district and is designated in the General Plan as an Employment Center because of its proximity to regional transportation infrastructure. The Envision General Plan augmented the North San Jose Area Development Policy, providing growth capacity for up to 97,000 new jobs, 32,000 new housing units, 26.7M sq. ft. of new industrial development, and 1.7M sq. ft. of supporting commercial uses.
Public hearings on the North San Jose Area Development Plan amendments and the EIR will begin in April 2016. The Draft EIR is expected to begin public circulation for review and comment in December 2016. A Notice of EIR Preparation will be circulated once more project specific details have been finalized. Public scoping meetings are anticipated to occur in the summer of 2016.

Accepting grant from MTC and VTA for urban village planning in N. 1st St. & Berryessa BART areas
Recommendation to adopt a resolution authorizing the City Manager or designee to accept grant funding from the Metropolitan Transportation Commission and the Valley Transportation Authority for urban village planning for the North First Street and Berryessa/BART Urban Villages. These grant opportunities will provide $866,162 in combined grant and local match funding for the development of those Urban Villages.

Sales Tax initiative may be added to June ballot
Council may adopt a resolution of the City Council calling and giving notice, on its own motion, for a Special Municipal Election to be held on June 7, 2016, to submit to the electors of the City of San José the following measure:
San José Local City Services To fund city services such as: improving police response to violent crimes, burglaries, and other safety needs; improving 911/emergency medical/fire response times; repairing potholes and streets; maintaining parks; expanding gang prevention; and creating jobs through economic development, shall the City of San José enact a ¼ percent sales tax for 9 years, providing about $40 million annually, requiring Independent Citizens Oversight with public review of spending, and all revenues controlled locally? YES/NO

City plans to award 69 new construction projects totaling $185M by June 2016
The Capital Improvement Program expects to award 69 projects valued at over $185M by the end of this fiscal year. These new projects include:
- Regional Wastewater Facility: significant investment is planned to occur over the next five years, centering on digester rehabilitation, blowers, filters, clarifiers, and headworks improvements, and construction of a new cogeneration and digested sludge dewatering facilities.
- Construction of new Municipal Water System facilities, maintenance of infrastructure, and improvements to existing Water Utility System facilities.
- HVAC system replacements at the Museum of Art and Shirikawa Community Center, with bids taking place in early 2016 and construction completed in July 2016.
- US 101/Blossom Hill Rd interchange improvements, BART construction support and the US 101/Maybury interchange development.
- Ground Transportation, FIS Baggage System Improvements, and FIS Curbside Improvements, which will be bundled as one project and will cost an estimated $9.6M.

Auditor’s report on City’s financial condition assesses whether City can pay its bills
At the direction of the Rules Cmte, the City Auditor’s office has prepared its first ever financial condition report for the City. The Committee will accept & provide input on the Auditor’s report & refer the item to the full Council meeting on March 8.
Highlights: The City has seen a moderate increase in revenues from a stronger economy after nearly a decade of General Fund deficits. However, the City now employs about 5.1 people per 1,000 residents, fewer than the 28-year average of 7.1 people per 1,000 residents. In addition, San Jose receives less tax revenue per capita than many neighboring cities, and faces an estimated $1.1B in deferred maintenance and infrastructure backlog and a $3.3B unfunded liability for pension and retiree health benefits.

Fire Department Organizational Review recs $22.7M increase in operating budget + up to $53M in capital improvements
The Fire Department underwent significant reductions over several fiscal years, which has severely impacted the Department’s service delivery. The Department struggles to continue to meet its adopted 80% at 8-minute response time goal, which creates challenges in providing equitable service throughout the community.
The Mayor’s June Budget Message for Fiscal Year 2014-2015 included direction to undertake a comprehensive organizational review of the Fire Dept. Citygate was hired to perform a Fire Department Organizational Review. The resulting report is presented here.

Approving June ballot measure that would require voter approval for Town Center zoning changes
City Council policy states that any staff work not part of an approved work program or budgeted item requiring more than four hours of staff time obtain approval of a majority of the City Council. Staff is seeking majority Council approval to commence with work effort necessary to fulfill the request to prepare a ballot measure requiring voter approval for any change to the Town Center Zone.
Approximately $83,631 will be required for placement of the ballot measure in the Voter Sample Ballot Pamphlet and on the June 7, 2016 ballot.

Possibly adding a jobs-housing scenario to Draft EIR analysis for Comprehensive Plan Update
On January 18th, 2016, the City Council and the Citizens Advisory Committee (CAC) held a joint meeting to review the upcoming release of the Draft Environmental Impact Report (DEIR or Draft EIR) for the Comprehensive Plan Update. The DEIR analyzes four planning scenarios at an equal level of detail, describing a range of potential land use and transportation policy decisions, and assessing the impacts they would have on traffic, greenhouse gas emissions, and other environmental resources. At the conclusion of this meeting, the Council adopted a motion (Attachment A) asking staff to return with a fifth scenario aimed at improving the City’s ratio of jobs to housing, which is commonly expressed as the ratio between jobs and employed residents. At a high level, this goal can be addressed by increasing the amount of housing, decreasing the amount of jobs projected between now and 2030 or some combination of the two.

Determining process to fill vacancy of Mayor after Jamie Matthews’ resignation
Former Mayor Jamie Matthews resigned from office, effective February 9, 2016, thereby creating a vacancy in the office of Mayor. To fill the vacancy, the City Council must now follow City Charter section 703 which sets forth the process for filling a vacancy in the elective offices of the City, including the Mayor. That section provides the Council with two options:
Appointment: Council may fill the vacancy by appointment within 30 days after the office is declared vacant. The Council can act to appoint by March 10, 2016. An action to appoint requires a majority vote. Any person appointed to the office of Mayor shall hold office for the balance of former Mayor Matthews’ unexpired term, i.e., until November 2018.
Election: If the Council does not appoint anyone by March 10, 2016, it must call an election to fill the vacancy within a reasonable time thereafter. Section 702 does not allow the calling of an election before the expiration of the 30-day appointment period; the earliest an election could be called is March 11, 2016. A special election must be held on an established election date. The last date to call the election on June 7th would have been February 12, 2016, but the 30 day appointment period made this infeasible. Consequently, the earliest possible election date to fill the vacancy is November 8, 2016. Under Government Code Section 36512, the City Council would have to call the election no later than July 15, 2016.

First of five study sessions to set 2016-17 budget priorities
During the January 12, 2016 Council and Authorities Concurrent meeting, a series of budget-related study sessions and public hearing dates were set to receive Council and public input and review the proposed 2016-17 Annual Budget, including Operating and Capital Improvement Project Budget (CIP). Included in the joint study sessions and public hearings are the City budgets, Successor Agency to the Redevelopment Agency budget, Sports & Open Space Authority (SOSA) budget, Housing Authority budget, Community Development Block Grant (included as part of the overall City Budget, although the CDBG Public Hearings have already been scheduled), the Federal entitlement Home Program (used for affordable housing purposes), and the Municipal Fee Schedule.
This is the first of five joint study sessions and is focused on received Council input on budget priorities. Staff will present an update at the beginning of the joint study session to provide the fiscal framework, including a high level overview of key fiscal drivers for the 2016-17 Budget.

Report on one-time rent adjustment between Stadium Authority and 49ers StadCo
The Stadium Lease between the Santa Clara Stadium Authority and the Forty Niners SC Stadium Company (StadCo) calls for StadCo to pay to the Stadium Authority an initial Facility Rent under the Lease of $24.5 million each year. The lease also includes a one-time adjustment in the Facility Rent if the amount of the Stadium Authority debt service or the operating expenses for the Stadium is more or less than the estimated amounts included Exhibit J of the lease. A rent adjustment is required after completion of construction when the actual amount of debt service is determined and when projections of Stadium Authority revenues and operating expenses can be based on the first year’s actual operations.
As reported in Stadium Authority Budget Status Reports, the close out of construction ran through the summer and into the fall of 2015 and the accounting firm of KPMG then completed a thorough cost allocation review of all Stadium expenditures in order to determine the final split of costs between the Stadium Authority and StadCo. As a result of this review, several million dollars of costs shifted to StadCo. This then led to a downward adjustment to the StadCo Subloan balance which resulted in lower overall debt for the Stadium Authority.
Since this information became available last fall, Finance Department Staff and the Stadium Authority’s economic consultants (Keyser Marston Associates) have spent the last few months working through the projections for Stadium Authority revenue, expenses and debt service with Finance staff from StadCo. The staff review has now been completed and the initial results were presented to Stadium Authority management last week.

West Valley Mission Community College District
$1M grant for Transit Infrastructure apprenticeship program w/ VTA
Recommendation that a $1M grant award from the California Community College Chancellor’s Office, California Apprenticeship Initiative New & Innovative Grant be authorized to Mission College and be distributed over a 2-year period. Based on an ongoing education/training partnership between Mission College and VTA, Mission College developed a successful application for this grant.
The funds will go towards the Mission College-VTA partnership to support an innovative “Grow Your Own through Apprenticeship” workforce development strategy, which responds to three challenges: a demand for expanded public transit infrastructure due to employment growth in Silicon Valley, an aging workforce, and the need to fill increasingly-technical jobs requiring specialized training.

Discovery Charter School requesting material revision to charter
The Discovery II Charter School Petition (grades TK-8) was approved by the Santa Clara County Board of Education (SCCBOE) on March 6, 2013, after it was denied by the San Jose Unified School District Board of Trustees. On February 4, 2015, SCCBOE approved a material revision to add a blended home school option to the Discovery II Charter School petition. On Feb 5, 2016, the Charter Schools Office of the Santa Clara County Office of Education received a request from Discovery II Charter School requesting a material revision to the charter currently authorized by the SCCBOE. This item will be placed on the March 16, 2016 board agenda for a decision. The material revisions remove outdated language and add language to be in compliance with SCCOE requirements.
