Santa Clara County

 Update on nonprofit Living Wage Policy & Ariba project

The County has held two public forums on developing a Living Wage Policy for Community-Based Nonprofit Contractors. At the second forum, Supervisor Chavez presented the Administration’s draft policy provisions, including:

  • $1/hr wage credits each for nonprofits that provide substantial tuition reimbursement/professional development benefits and/or vision & dental insurance;
  • Phasing in the Living Wage rate from July 1, 2018 to July 1, 2020;
  • Establishing a per-contract hardship exemption approval process.

The Administration is working with Supervisor Chavez and her staff to schedule a special committee hearing on the proposed policy provisions, targeting August 2017.

Memo from Peralez/Jones/Jimenez/Arenas proposing revisions to Team San Jose performance measures

Deferred from 5/16/17 – Item 4.3. Memo from CMs Peralez, Jones, Jimenez, and Arenas supports staff recommendations authorizing the City Manager to negotiate and execute an amendment to the Team San Jose contract to revise its performance measures, enhance its reporting requirements, and revise the incentive fee contract model to a management fee model in accordance with the recommendations outlined in this memorandum.

The City’s industry advisor (Conventions, Sports and Leisure) evaluated the TSJ/City contract and associated performance measures and compared them to comparable organizations across the United States. Based on this analysis, CSL is making a series of recommendations to the City to revise the TSJ performance measures so that they are more meaningful and a clear gauge of TSJ’s efficacy. Furthermore, CSL is recommending a “dashboard” set of data that TSJ and the City track that will provide information about industry and economic trends including TSJ industry segments like the tech sector.

Mayor’s budget message

Recommendations from Mayor Liccardo for City Council to:

Approve the City Manager’s Proposed Budget with the additional direction outlined in this memorandum for purposes of adopting a final budget for Fiscal Year 2017-2018.

Adopt a resolution authorizing the City Manager to negotiate and execute agreements for projects approved in the Mayor’s Budget Message when amounts exceed the City Manager’s existing contract authority provided that any required environmental review for the project has been completed.

Authorize the changes proposed in the following Manager’s Budget Addenda and incorporate them in the Adopted Budget, except in cases where the Addenda are amended or superseded by the contents of this Budget Message.

MEMO from Liccardo/Rocha recommending letter to County re Measure A; affordable housing analysis for Urban Villages; and developing City strategy for moderate-income housing

New memo from Mayor and CM Rocha recommends

  • approving the staff report.
  • Direct the City Manager to continue prioritizing funds for the development of very low and low- income rental housing.
  • Return to Community and Economic Development Committee with a moderate-income housing strategy that focuses on policy development options such as:
    1. Legislative actions that could facilitate development; and
    2. Encouraging “affordable by design” housing that is smaller and more efficient; and
    3. Densification in key opportunity development areas; and
    4. Leveraging private corporate funds, particularly with anticipation of new federal tax legislation
  • Direct the City Manager to draft a letter to the County providing input on Measure A implementation. Staff should present their recommendations to the City Council for approval and secondly, send the letter to the Board of Supervisors and appropriate County of Santa Clara staff before the July legislative break.
  • Direct the City Manager to return to Council with a baseline affordable housing stock analysis for each Urban Village. Information collected as part of that baseline could include:
    1. Total number of deed-restricted affordable housing and their dates of expiration; and
    2. Total number of rent-controlled units; and
    3. Total number of mobile homes; and
    4. Other information that staff believes useful.
  • Direct the City Manager to provide in the next Housing Element an analysis, to the extent feasible, that compares the projected need for affordable housing (according to RHNA or some other source) with the projected number of affordable units that that we could reasonably expect to produce with existing funding sources, for the purpose of trying to understand whether additional funding sources are needed to fully meet demand, and if so, what the magnitude that additional funding need would be

Rejecting all proposals for the LED Streetlight Replacement Project & directing City Manager to complete the Broadband Strategy first, Mayor and CM Rocha recommend deferral to June 13

New memo from Mayor Liccardo and CM Rocha recommends deferring the hearing of this item’s actions related to the RFP of the Innovative LED Streetlight Replacement until the June 13 city council meeting and agendize the hearing for the Philips Lighting appeal on the same day.

Memo from CM Khamis recommends approving the recommendations in Memorandum from Assistant City Manager David Sykes dated May 22, 2017, with the following additions:

Since staff issued its original report in January, several factors have emerged to change staff’s analysis and recommendations. Most significantly, the streetlight poles may be a more valuable real estate asset than previously assumed. A consultant hired to identify gaps and opportunities in the city’s broadband infrastructure identified the light pole as the most critical City asset in the Broadband Strategy and recommended deferring any action that might jeopardize the City’s ability to fully monetize the value of the light pole real estate. Staff plans to bring forward a Broadband Strategy for Council consideration in the fall. Moving forward with any of the installation proposals now in advance of the completion of the Broadband Strategy could tie up the streetlight poles and prevent implementation of the Strategy.

In addition to this concern, staff were concerned that the city’s General Fund would bear significant risk of paying the loan for construction of the lights should revenue projections, energy savings, or other fiscal components of the project not come to fruition, and that some of the proposals received were still premature.

CMs Rocha and Peralez recommend developing a strategy to survey potentially historic structures, in reaction to Greyhound project

In reaction to the City Council approving the Greyhound Residential Project in Downtown San Jose at the May 23, 2017 meeting, CMs Rocha and Peralez recommend directing City Staff to develop and implement a strategy to survey structures that are potentially eligible for historic designation in the city, including:

  1. Hiring a staff member in the Planning, Building & Code Enforcement (PBCE) department to manage the survey.
  2. Utilizing the $627,000 from fines, fees and donations collected by PBCE to implement this strategy.

Introducing ordinance repealing Right-to-Lease Ordinance and Rental Housing Dispute Resolution Program to avoid statutory confusion and conflict with recently passed Community Stabilization and Fair Rent Act

The City Attorney’s Office and Community Development Department are recommending that Council introduce an ordinance repealing the Right-to-Lease Ordinance and the Rental Housing Dispute Resolution Program and direct staff to eliminate the Rental Housing Dispute Resolution Program Fee from the Master Fee Schedule for Fiscal Year 2017-18.

West Valley-Mission Community College District

Discussing proposed June 2018 General Obligation Bond election to pay for unfunded Capital Outlay Plan projects

The Chancellor’s Office is recommending that the Board receive information on the timeline for an anticipated June 2018 local General Obligation Bond election. Further, the Board will give direction for the conduct of a bond survey.

On November 2, 2004, the voters approved the District’s issuance of up to $235 million in general obligation bonds (Measure H). The election was conducted under Proposition 39, which allowed for a 55 percent majority vote. On May 18, 2006, the District issued the first series of bonds in the aggregate amount of $100 million. On June 2, 2009, the District issued the final series of bonds totaling $135 million. The funds from Measure H have been completely expended.

On June 5, 2012, the voters approved the District’s issuance of a $350 million general obligation bond (Measure C). The first issue, in the amount of $100 million, was sold in August 2012 making funds available for major construction projects at West Valley College and Mission College. On January 15, 2013, the Board approved the Measure C Project Priority List allocating $34.6 million for District Services projects, $157.7 million for Mission College projects and $157.7 million for West Valley College. The second issue, in the amount of $150 million, was sold in February 2015. The third issuance for $100 million is expected to be sold in September/October 2018. Approximately $120,492,922 has been spent thru March 31, 2018. An additional $78,424,766 has been encumbered. The balance of $51,082,312 is committed to projects previously approved by the Board.

West Valley College’s Educational & Facilities Master Plan was completed in June 2015. Mission College’s Master Plan should be completed by May 31, 2017. Both Master Plans identify unfunded capital outlay projects for the District. The most viable option to address these unfunded college facilities needs is a local bond election for June 2018.
