Consider impact fees for residential and non-residential development at Stanford University and in unincorporated areas of the County

The Board will: (a) Receive report and Affordable Housing Nexus Studies; (b) Direct Administration and County Counsel to prepare an ordinance implementing affordable housing impact fees for Academic Space (non-residential) and Faculty and Staff Housing (residential) development at the Stanford University campus at the level supported by the Affordable Housing Nexus Studies; (c) Direct Administration to conduct outreach to the public and interested parties to solicit input on the adoption of affordable housing impact fees for the Stanford University campus and submit a proposed implementing ordinance and results of public outreach to the Board in August 2018; and (d) Direct Administration to continue evaluating and conducting public outreach on an ordinance implementing housing impact fees for residential and non-residential development on unincorporated lands outside of the Stanford University Campus and report to the Board in 2019 with the results of the evaluation and outreach. Nexus analysis found that potential fee could be $143 per square foot.

Approve special elections to occur on June 5, 2018 for Regional Measure 3 (Bridge Tolls) and possible removal of Judge Persky

The Board will adopt two resolutions related to special elections to occur on the June 5, 2018 primary election date: (1) a recall election for Judge Aaron Persky, including an election to replace him and (2) an election related to the increase of Bay Area bridge tolls.

Purchase 2 large parking lots adjacent to Great America/Levi’s Stadium

The Board will: (a) Adopt Resolution of Intent to purchase real property, commonly known as the North-South Lot located at 4911 Great America Parkway, Santa Clara, APN 104-43-051, from the Successor Agency of the Former Redevelopment Agency of the City of San Jose and (b) Authorize Clerk of the Board to set Tuesday, June 5, 2018, no earlier than 10:00 a.m., as the date and time to consider the acquisition of the Real Property.

Approval of the recommended action is necessary for the Board to consider the acquisition of real property, commonly known as the North-South Lot located at 4911 Great America Parkway, Santa Clara, CA (Assessor’s Parcel Number 104-43-051) (the “Property”).  The Property is currently encumbered by two long term parking easements/agreements.  Therefore, the current use will not change.

The Property is currently being used for approximately 1,220 parking spaces utilized by both California’s Great America Theme Park and Levi’s Stadium.  Authorizing the Clerk of the Board to set public hearing for June 5, 2018, no earlier than 10:00 a.m., allows the public the opportunity to comment on the acquisition of this real property.

Adopt resolution of intent to purchase property at San Jose Convention South Hall site for $40m

The Board will: (a) Adopt Resolution of Intent to purchase real property located on the block bounded by South Market Street, South Almaden Boulevard, Viola Avenue, and Balbach Street in San Jose, commonly known as the South Hall Site, Assessor’s Parcel Nos. 264-30-010 through 264-30-028 and 264-30-136, from the Successor Agency of the Former Redevelopment Agency of the City of San Jose and (b) Authorize Clerk of the Board to set Tuesday, June 5, 2018, no earlier than 10:00 a.m., as the date and time to consider the acquisition of the Real Property.

Approval of the recommended action is necessary for the Board to consider the acquisition of real property, commonly known as the South Hall Site, San José. The Property boundaries are South Market Street, South Almaden Boulevard, Viola Avenue, and Balbach Street. Purchase price will not exceed $40,000,000. Authorizing the Clerk of the Board to set public hearing for June 5, 2018, no earlier than 10:00 a.m., allows the public the opportunity to comment on the acquisition of this real property.

Approve a contract to fund a project related to micro-surfacing of certain county roads

The Board will approve a contract to fund a project related to micro-surfacing of certain county roads. The contract provides for the application of a micro-surfacing treatment on 12.45 miles of residential roads in unincorporated urban pockets, consistent with the Department’s 10-Year Road Maintenance Plan. As part of the Plan, all roads to be micro-surfaced receive road repairs (dig outs, crack seals and spot overlays), performed by Department personnel, before micro-surfacing is applied.

City of San Jose

Fourth Meeting of the San Jose Google/Diridon Station Advisory Group (SAAG)

The Station Area Advisory Group will meet for the third time to discuss the ongoing planning for the Google development at Diridon Station. The group will discuss finalization of topics and assignments and schedule for Solution Groups, announcement of walking tour dates for the Diridon Station Area for SAAG members and the public. They will also hear Diridon Station area transportation update and hear presentations by City staff on the range of planned transportation improvements to the Diridon Station, including High Speed Rail and the BART extension. The presentations will include the improvements expected, the timing, and the potential benefits to the regional transportation system. Lastly, volunteers from the SAAG will each present on their organization’s platform, and their inspirations and ideas for Google and the City to consider for the Diridon Station Area.

Approve $1.4 m contract for low bidder (JMB Construction) for sanitary sewer repairs

The Council will hear a report on bids and award of contract for the 8730-Sanitary Sewer Repairs 2017-18 Package IV Project to the low bidder, JMB Construction Inc., in the amount of $1,410,045, and approve a contingency in the amount of $141,005.

Approve changes to the affordable housing impact fee and related in-lieu fee

The Council will:

(a)      Adopt a resolution to establish a reduction in the Inclusionary In-Lieu Fee to $0 (per In-Lieu unit) as an incentive for High-Rise rental developments in the Downtown Core (as described in Resolution Number 73587 adopted January 9, 2007) that are ten  (10) or more floors or stories in height not including any nonresidential uses where the highest occupied floor has a floor level elevation is at least 150 feet above street level, if they obtain issuance of all Certificates of Occupancy on or prior to June 30, 2021.

(b)      Adopt a resolution that amends Resolution No. 77218 as previously amended by Resolutions No. 78010, 78392 and 78473 (collectively the “Housing Impact Fee Resolution”) by updating Section 13 regarding the transitionbetween the Affordable Housing Impact Fee and Inclusionary Housing Ordinance Programs to (1) replace the requirement for issuance of Building Permits with a requirement for submittal of final approved building plans; (2) to add a transition process for rental projects that have not recorded an affordable housing agreement but were eligible for the AHIF Pipeline Exemption;  (3) to add a transition process for rental projects with tentative maps approved prior to June 30, 2018; (4) allow Downtown High-Rise projects that fail to obtain Certificates of Occupancy by the applicable due date to pay the housing impact fee rather than meet the inclusionary housing ordinance requirements if they have obtained Building Permits; and (5) clarify that the AHIF continues to apply to projects with less than 20 units; and

(c)      Accept the Housing Department’s staff report regarding the transition from the Affordable Housing Impact Fee (AHIF) to the Inclusionary Housing Ordinance (IHO) program for new rental developments in San José.

City of Milpitas

Implementing a Wage Theft Procurement Policy for the City

Staff recommend adoption of a resolution implementing a Wage Theft Procurement Policy for the City of Milpitas. The topic of wage theft, including the recommended ordinance and procurement policy, was presented to the City’s Economic Development Commission. Commissioners voted 7 – 1 to recommend to the City Council to direct staff to draft a wage theft ordinance and procurement policy. Staff also presented both the ordinance and the procurement policy to the Milpitas Chamber of Commerce Board of Directors on Thursday, February 1, 2018.

Potential contractors, subcontractors, consultants or businesses entering into an agreement with the City to provide goods or services are required to disclose prior wage theft court orders or final administrative actions for the past five years during the contract solicitation process. Wage Theft policies could have a significant impact on workers who are struggling to collect on owed wages and benefits. The proposed ordinance will give the City authority to revoke or suspend the business license of any employer who refuses to pay its workers when found by a local, state or federal agency in violations of wage or hour laws. Without a business license an employer would effectively not be able to operate in Milpitas. The state agency responsible for enforcing state labor laws is the Division of Labor Standards Enforcement lead by the Labor Commissioner. The most common recourse for employees who have suffered wage theft is to file a claim with the Labor Commissioner’s Office. Even when an employee is awarded a judgment it can be very difficult for them to collect. The Santa Clara County Wage Theft Coalition reported only one third of owed wages were ever paid to workers from 2012 to 2013.

Wage theft is the denial of wages or employee benefits that are rightfully owed to an employee. Wage theft can be failure to pay overtime, minimum wage violations, employee misclassification, illegal deductions in pay, working off the clock, or not being paid at all. The proposed policy 1) requires potential contractors to disclose prior wage theft court orders or final administrative actions during the contract solicitation process; 2) requires City contractors to disclose wage theft court orders or final administrative actions during the term of the contract; 3) requires City contractors and subcontractors to comply with all wage and hour laws. Milpitas City Council adopted wage theft ordinance for all employers in the City on March 20, 2018.

Santa Clara County Office of Education

Deny charter school petition for Eureka! Inclusive Charter Schools

On March 7, 2018, the Charter Schools Office of the Santa Clara County Office of Education received a Petition for the Eureka! Inclusive Charter School, a district appeal TK-8th grade charter school which is proposed to serve 160 students in year 1 and grow to 239 students by year 4 and will be located in San Jose Unified School District.  Eureka! Inclusive was denied by San Jose Unified School District on February 7, 2018.  It submitted its petition to the SCCOE and plans to open its doors during the fall of 2018.

Staff reviewed the Petition utilizing the criteria for approval set forth in Education Code Section 47605.  Based upon its comprehensive review and analysis of the Petition, Staff finds that the Charter School presents an unsound educational program for the pupils to be enrolled in the Charter School, the Petitioners are demonstrably unlikely to implement the program as presented, and the Petition does not contain reasonably comprehensive descriptions of all of the required elements of a charter petition, including but not limited to the Education Program, Racial and Ethnic Balance of the school, Employee Qualifications, and Admissions Policies and Procedures.  Accordingly, Staff recommends that the Board take action to deny this Petition by adoption of the proposed Resolution setting forth written factual findings and incorporating by reference the factual findings set forth above, specific to the Eureka! Inclusive Charter Petition supporting denial of the Charter.

Initial proposals for reopener and successor negotiations with West Valley-Mission Classified Employees Association
