Consider Resolution to approve purchase of Saint Louise Regional Hospital in Gilroy, CA

On November 6, 2018, the Board approved the acquisition of Saint Louise Regional Hospital, currently owned by Verity Health System of California—a nonprofit public benefit corporation that has declared bankruptcy. Adhering to standard due diligence and public notification procedures for a purchase of this size and type, Staff recommends adoption of a Resolution of Intention to Purchase Real Property of Saint Louise regional Hospital, and to authorize the Clerk of the Board to set Tuesday, December 18, 2018 at no earlier than 10:00 a.m. as the date and time to consider acquisition of the real property.

If approved by the Board, the Clerk of the Board will: (1) send notification to Kim Forrester in the office of the County Counsel when the executed Resolution and proof of publication are available; (2) set December 18, 2018 at 10:00 a.m. as the date and time to approve acquisition of the property; and (3) publish notification of Notice of Intent to Purchase Real Property for three weeks prior to December 18, 2018.

Consider Resolution laying out funding for the purchase of Saint Louise Regional Hospital

On November 6, 2018, the Board approved the acquisition of Saint Louise Regional Hospital, currently owned by Verity Health System of California—a nonprofit public benefit corporation that has declared bankruptcy. The purchase will be financed through the issuance of lease revenue bonds. However, since the lease revenue bonds will not be issued until after the purchase of the hospital, funds must first be paid from the General Capital Improvements Fund. This proposal recommends adoption of a Resolution declaring the County’s official intent to reimburse the General Capital Improvements Fund from bond proceeds for acquisition-related expenditures. The proposed Resolution would cap the funding for the hospital purchase at $300 million would give the purchase a formal designation of Capital Project 263-CP19014 “Purchase of Verity Hospitals.”

City of San Jose

Approving sale of Jose Theater to Imwalle for $2.1M

The Jose Theater, located at 62 South Second Street, was built in 1904 and is the oldest theater in Downtown San Jose. The former San Jose Redevelopment Agency purchased the Property in 2000 for $845,000 and completed seismic and facade upgrades to the building. It has four historic designations: National Register Historic District; City Landmark; City Historic Contributing Structure and listed in the California Register of Historic Resources.

In 2001, the Agency Board approved a Lease with the Comedy Club of San Jose, LLC (“Improv”). The Improv’s current lease ends in Dec. 2020.

On August 30, 2018, Successor Agency staff placed the Property out to bid. 3 bids were submitted. Successor Agency staff recommends approving the sale to the highest bidder, Monterey & Third Associates, affiliated with Imwalle Properties. The buyer will take the Property subject to the Improv’s lease, which has a remaining term of 2 years and 2 months. On November 5, 2018, the Countywide Oversight Board unanimously approved the sale of the Property to Monterey & Third Associates.

Recommendation: Successor Agency Board approve a Purchase and Sale Agreement and Escrow Instructions between the Successor Agency to the Redevelopment Agency of the City of San José, as seller and Monterey & Third Associates LLC, as buyer to allow the sale of 62 South 2nd Street for a purchase price of $2,139,000.

Revising Measure T project list to prioritize fire stations, per Liccardo memo

The Rules Committee recommends (in response to memo put forth by Mayor Liccardo at prior mtg) that City Council direct the City Manager to focus Measure T project list on fire stations, as follows:

  1. Revise Proposed General Obligation Bond Project Categories to keep “Build Fire Station 37” as a priority project; to change the point on “Rebuild/relocate or build two fire stations” to “Build at least two new fire stations, including property acquisition, or conversion of existing City land and rebuild/ relocate fire stations 8 and 23,” and change the point about “Public Safety Headquarters Infrastructure Needs” to specifically “Police Headquarters Infrastructure Needs”
  2. Accelerate the development of a Facilities Master Plan with specific timelines for the construction and rehabilitation of the fire stations called for under Measure T.
  3. Within 60 days of the certification of the election results, return to Council with a timeline for the implementation and funding of staffing/operations of Fire Station 3 7, and a timeline for the construction of the next new fire station, with the purchase of land within 24 months.

Approving MOU and Purchase & Sale Agreement with Google for Diridon development

City of Palo Alto

Adopting Housing Element for the city’s Comprehensive Plan

Staff recommends that the City Council:

  1. Find the proposed ordinance is consistent with the Comprehensive Plan Update Final Environmental Impact Report.
  2. Adopt the attached ordinance (Attachment A)

In short, the proposed ordinance makes gains toward increased housing production while balancing interests to preserve neighborhood character. This report summarizes work completed over the past year to develop the 2018 Comprehensive Plan Implementation/ Housing Ordinance.

  3. Work completed by the Architectural Review Board and Planning & Transportation Commission on drafting the 2018 Comprehensive Plan Implementation/Housing Ordinance

  1. Findings from an evaluation of parking demand and supply in multifamily developments in Palo Alto.
  2. The Discussion section presents zoning revisions identified in the ordinance in Attachment A that meet the intent of the Housing Work Plan and describes the rationale for each zoning change.
  3. The Analysis section analyzes potential impacts of the draft zoning revisions, including how the revisions would increase housing production and affordability, and implications under State  Density Bonus Law and SB35 streamlining provisions. Additionally, massing models of how hypothetical sites could buildout under existing and proposed standards are provided in Attachments B and C.

City of Sunnyvale

Adopting Resolution of intent to transition to district-based City Council elections

Staff recommends that the Council Adopt Resolution Declaring the City of Sunnyvale’s Intent to Transition from At-Large to District-Based City Council Elections, Outlining Specific Steps to be Undertaken to Facilitate the Transition, and Estimating a Time Frame for Action Pursuant to Elections Code.

On September 5, the City Council held a public hearing regarding changing from the City’s current at-large with numbered seats system for electing City Council members to a district-based form of elections with the goal of placing a measure on the November 2020 ballot for voters to decide whether to amend the City Charter. On October 9, the City received a certified letter from attorney Laura Ho of the law firm Goldstein, Borgen, Dardarian & Ho, alleging that the City’s current electoral system violates the California Voting Rights Act (“CVRA”) because it “dilutes the voting power of Asian American voters.” The City Attorney met with Ms. Ho the week following receipt of the letter, and has had ongoing discussions over the past month. The City Council also met in closed session three times to discuss the potential litigation and options for settlement. Although the demand letter commended the City for initiating steps to transition to district based elections and purported to offer extensions to timeframes set forth in the CVRA “safe harbor” legislation, the parties have thus far been unable to reach agreement on specific terms for a stipulation on extended timeframes or settlement.

Adopting this resolution of intent will confirm the Council’s prior direction to move forward with a change to district based elections through public engagement and a ballot measure to amend the city council election provisions in the City Charter, and prohibit the potential plaintiffs from filing a lawsuit for an additional 90-day period (through February 20, 2019), during which the Council is scheduled to review and approve the public outreach plan regarding changing to district-based elections.
