Superior Court Judge Orders Full Count of Remaining Signatures
San José, CA — A judge signed an order requiring the County Registrar of Voters (ROV) to conduct a full count of every voter’s signature in their possession to determine whether the Fair Elections Initiative qualifies for the November 2020 ballot.
The order comes on the heels of the startling revelation that the San Jose City Clerk Toni Taber lost thousands of voter signatures on the initiative petition. The City Clerk reported receiving almost 97,000 signatures. See the clerk’s count here. However, she delivered only 94,202 signatures to the County Registrar of Voters.
The order, which was sought by the County Counsel, reverses an earlier finding by the Registrar’s Office that the petition was insufficient. Specifically, the ruling enforced California Election Code 9115 (b), which states that “if the statistical sampling [which was conducted by the ROV] shows that the number of valid signatures is within 95 to 110 percent of the number of signatures of qualified voters needed to declare the petition sufficient, the elections official shall, within 60 days from the date of the filing of the petition, excluding Saturdays, Sundays, and holidays, examine and verify the signatures filed.” It was determined that the number of valid signatures examined during the statistical sampling of the Fair Elections Initiative fell within the above indicated percentages of valid signatures, thereby requiring by law a count of the remaining signatures.
