Renters’ rights and affordable housing

Two proposals are being put forward addressing the crisis facing renters in San Jose.

From Council member Peralez:  A prohibition against discrimination based on source of income (Section 8 and other housing subsidies).  Recommendations on improvements and a comprehensive analysis of the data and effectiveness of the City of San Jose’s Rental Rights and Referrals Program. Rent Control Modification.

From Mayor Liccardo: Direct the City Manager to accept the recommendations made by Councilmember Peralez among a range of potential options for the City’s response to the housing affordability crisis, along with those listed below. Return to Council with a workload assessment, prioritizing those measures that can be quickly implemented, and referring those requiring more extensive staff work in concert with community stakeholders through the Council’s prioritization process.  This is happening at the Rules Committee Wednesday May 13.

Rezoning for retail, not housing

Staff will make a presentation that emphasizes a jobs-housing imbalance in San Jose and negative impacts of converting industrial zoned land to housing.  Council members Peralez and Rocha want to review the current general plan with an eye on making sure there’s a better balance of retail, market rate housing and affordable housing. The Mayor adds his input on the plan with a focus on preserving commercial and industrial lands.

Republic Services rate increase

City staff recommends approving a 4% rate increase from Republic Services, the City’s recycling contractor.  In the meantime, staff in the Public Works and City Manager’s office  are addressing issues related to the $4.8 million in back pay the company owes its employees for failing to comply with living wage requirements, and the $14.4 million Republic owes to the city in fines for violating the city’s living wage policy.

The rate increase goes before council May 19.

Sharks Extend SAP Center Lease

Also coming up at council May 19.

The proposed actions will extend the term of the agreement with Sharks Sports & Entertainment (SSE) for management of the SAP Center, reduce SSE payments to the City for lease of the SAP Center and the Ice Centre and provide direction to transfer $3.5 million from the City’s Debt Service Payments Reserve for Capital Repairs for the SAP Center.

The financial provisions in the proposed term Sheet include fixed lease payments to the City of approximately $16 million during the remaining three years of the current Management Agreement, which represents a reduction of approximately $2 million compared to the current agreement. In addition, the Term Sheet provides for a one-time capital contribution by the City of $6 million for capital and modernization needs at the SAP Center. A reduction in payments to the City under the Ice Center Agreement of $5.25 million is also recommended.

Santa Clara County

Plans for County Fairgrounds

The proposed Fairgrounds master plan would require the use of somewhere between 60 to 90 acres, depending upon the desire to retain flexibility to grow over time, and depending upon what co-location uses are possible. That would leave the remaining 60-90 acres available for alternative, non-Fairgrounds uses.  This is the second phase of a three phase project. The consulting team is preparing for the Board of Supervisors’ consideration, a series of alternative scenarios, illustrating the trade-offs required in each, both the plusses and minuses of different uses and configurations.
