Approving amending the Minimum Wage Ordinance to reach $15 by July 2019 & adding exemption for youth under 18

Recommended action: Approve an ordinance amending the San José Municipal Code relating to Minimum Wage.

On November 15, 2016, City Council directed staff to return on November 29, 2016 with an ordinance to modify the existing minimum wage ordinance as follows:

  1. Increase San Jose’s minimum wage to $10.50 in January 2017, for consistency with the state schedule across employers of all sizes.
  1. Increase San Jose’s minimum wage to $12 on July 1, 2017, $13.50 on July 1, 2018 and $15 on July 1,2019.
  1. Include an ‘off ramp’ provision with two economic triggers similar to the State of California, providing option to delay scheduled increase to the minimum wage if a severe recession occurs during the ramp up to $15.
  1. Change the CPI index used for annual increases from the U.S. All Cities CPI-W to the San Francisco-Oakland-San Jose Consolidated Metropolitan Statistical Area (CMSA) CPI-W to more accurately account for the cost of living adjustments in this area, capped at 5% and rounded to the nearest five cents.
  1. Include an exemption for youth (below 18 years of age) in training/education employment programs,limited to 120 days annually per position and per trainee.

Updates to City’s Workers’ Comp program

(3.7) Continuation of a hybrid service delivery model for the City’s Workers’ Compensation Program that uses a combination of in-house staff and a Third Party Administrator through June 2018. (3.8) Report on RFP responses and authorizing agreement with Intercare (Orange, CA) to administer Workers Compensation claims processing with an initial term beginning November 29, 2016 through June 30, 2018, with an option to extend annually through June 30, 2021, for a not to exceed total compensation amount of $16,264,409 based on an estimated caseload of 1501-1700 claims, and subject to annual appropriation of funds. (3.9) Authorize agreement with DAVID Corporation (Wakefield, MA) to provide a new cloud-based Workers’ Compensation System to replace the City’s current aging legacy system in support of the HR Department requirements.

Appoint Sergio Jimenez early as interim District 2 Council Member

Recommendation to appoint Sergio Jimenez as the interim representative for the anticipated vacancy in Council District 2 to serve from the date of vacancy of the Council District 2 seat until the remaining term of office expires on December 31, 2016. Ask Kalra will be sworn into the CA State Assembly on Monday, December 5.

Santa Clara City

Update on efforts to obtain missing documents from 49ers Stadium Management Company for Stadium Authority audit and agreement

Staff will be providing an update to Council and the Stadium Authority Board regarding efforts to obtain missing documents from the 49ers Stadium Management Company (Management Co) requested as part of an audit of Stadium Authority (SA) activities conducted by Harvey M. Rose Associates, LLC.

Staff was also directed to have a “demand letter” ready to be transmitted to Management Co if the above requirements were not met by November 22, 2016. A draft of the letter prepared by the City Attorney is attached. SA staff, including the Executive Director, Finance Director and Counsel, will meet with Management Co representatives at their headquarters on November 18 to determine that all documents required by the auditor and the agreement are available.

Approving job description and appointing ad-hoc committee to select new Stadium Oversight Manager

Approval of a New Job Description for Stadium Oversight Manager, Setting of the Control Point at $16,849 per month, and Addition to the City’s Conflict of Interest Code, Disclosure Category 1; and Approval of the appointment of a three member Ad Hoc Sub Committee to provide input to the City Manager on the selection process of a Stadium Oversight Manager and note and file the report.

Council will be approving two actions related to ensuring proper management of Stadium Authority finances and activities – including approving a job description for a new Stadium Oversight Manager position, and appointing a 3-member ad hoc committee to support the City Manger in selecting an appropriate candidate for this position. This division manager position will report directly to the City Manager/Stadium Authority Executive Director, creating a new classification at the management level within the City Manager’s Office. The City is recommending a Control Point of $16,849 per month, and the City Manager’s Office budgeted $175,301 for this position during fiscal year 2016/2017. The job description includes a conflict of interest statement requirement.

VTA

Special board meeting to give direction on Next Network 

ACTION ITEM – Direct staff to design a draft transit network employing an 85/15 balance between ridership-purposed and coverage-purposed services.  [Staff rec is to move from the current 70/30 ridership/coverage split to 85/15.]

A central element of VTA’s Next Network Plan has been determining the appropriate balance between ridership and coverage services. This question concerns how much of VTA’s transit operating budget should be spent on ridership-purposed services and how much should be spent on coverage-purposed services. Presently, 70 percent of VTA’s operating budget is spent on ridership-purposed routes-routes that travel through dense, walkable, transit-supportive places. 30 percent is spent on coverage-purposed routes-routes that provide transit access to parts of the county with little regard for ridership demand.

Determining the appropriate balance between ridership and coverage speaks to how VTA envisions its role as a transit operator given the county’s transportation needs, challenges and VTA’s obligation to use public funds in a cost-effective manner.
