Second reading and Cortese amendments to housing voucher non-discrimination policy
The Board will vote on a second reading of Ordinance No. NS-507.1, which would ensure that all persons with the ability to pay for housing, whether through their own funds or using a subsidy, are considered for housing. This will prevent landlords in unincorporated areas of Santa Clara County from refusing to accept Section 8 vouchers.
Supervisor Cortese requests the Ordinance be amended to provide that penalties can only be imposed on individuals who fail to comply with the Ordinance after first receiving notice in writing that they are or may be in violation of the Ordinance. He also requests that the Administration design and conduct a comprehensive outreach plan to inform landlords, property owners, rental assistance program administrators, and other key stakeholders of the affordable housing Ordinance and rental assistance subsidy programs. Approving child care subsidy pilot plan
AB 2368 (Gordon) would authorize Santa Clara County to develop and implement an individualized county child care subsidy plan, similar to the plans created by San Mateo, San Francisco, and Alameda counties. The bill requires the Board of Supervisors to approve the plan.

Approving an ordinance prohibiting SSBs in kids meals & direction on prohibiting sale of SSBs in County health facilities
The Board will receive a report from the Public Health Department relating to policy recommendations to provide consumers with information about the health risks associated with sugar-sweetened beverages and to reduce overconsumption of these beverages. They will also consider the Public Health Department’s strategy to develop a Santa Clara Valley Health and Hospital System policy to prohibit the sale and distribution of sugar-sweetened beverages at all County-run health facilities. Additional PHD recommendations include offering training to child care providers on SSB consumption impacts; and additional Water to Go stations.
Item 9 is the adoption of an ordinance to prohibit restaurants from (1) offering drinks other than water or milk, with no added sweeteners, in combination with a kids’ meal and (2) providing incentive items linked to the purchase of a drink other than water or milk, with no added sweetener.

Direction on creating a pilot house-sharing program
Receive report from the Office of Supportive Housing relating to a proposed pilot house sharing program. The OSH estimates that an appropriate budget for a pilot house sharing program would be $550,000 to $650,000 a year –to support four full-time staff, volunteers, program operating expenses, and administrative supplies and services. The initial pilot period should be for two and half to three years. The goal of the program should be to make at least 100 successful matches annually. A match would be successful if a renter moves into a home and stays for at least three months. The program should not exclude any individuals or households based solely on income level, rather, could be targeted to certain populations such as older adults and younger professionals. In addition, either the home provider or the home seeker should be earning no more than 80% of the area median income.

Recommendations from the special hearing on immigration
Following the Children, Seniors, and Families Committee special hearing on immigration, the Board directed staff to develop a set of recommendations to address concerns raised at the hearing. These recommendations include:
- Analyze how sensitive data held by the County is protected from other agencies;
- Explore partnering with community colleges on know-your-rights trainings;
- Help immigrant families develop emergency plans in case a parent is detained or deported;
- Provide legal and educational support to immigrant communities.

Extension of ENA for redevelopment of Museum Place project – Liccardo/Carrasco/Peralez/Rocha memo directs effort for local trades hiring and labor peace agreement for any future hotel on site
New memo from Mayor Liccardo and CMs Carrasco, Peralez, and Rocha recommends approving staff recommendation to extend the ENA with Insight Realty, but with the following direction that the City Manager:
- Extend the ENA by 120 days (rather than 180 days), and return to Council in August 2017, with a Disposition and Development Agreement (DDA) or alternatively, a recommendation for other disposition of the parcels; and,
- Comply with prior Council direction (from the October 6, 2015 approval of the ENA), regarding items 2, 3i, 3iv, and 3vi, as outlined in the attached memorandum.

- Prepare a development schedule that locks in delivery of the proposed development in this market cycle, with an opt-out for non-performance.

Original staff rec: Authorize the negotiation and execution of an amendment to the Exclusive Negotiation Agreement (ENA) with Insight Realty Company to extend the ENA six months to complete a Disposition and Development Agreement related to Parkside Hall. Approval enables the developer, the City, and The Tech Museum to finalize project details and negotiations of the Disposition and Development Agreement for Parkside Hall and to complete the environmental review necessary to obtain CEQA clearance. This six-month extension would commence on May 1, 2017 and end on October 31, 2017. With the complexity of the project and number of stakeholders involved, the City team and developer made significant progress, but require more time to finalize the DDA and related CEQA work.

Implementing Changes from the Alternative Pension Reform Framework Agreement and Measure F deferred to 5/2
DEFERRED TO 5/2/17 PER RULES COMMITTEE -Staff recommends that the Council approve various amendments to implement revisions to the pension and retiree healthcare plans for members of the City of San Jose Federated Retirement Plan and Measure F. Measure F included, among other things, prohibiting any enhancements to defined retirement benefits without voter approval; codifying the Tier 2 pension benefit; closing the defined benefit retiree healthcare plan; and prohibiting retroactive defined retirement benefit enhancements. In addition, the following two amendments were incorporated by bargaining groups:
- Re-Enrollment of Retirees after Alternative Coverage – A change was requested by retirees to ensure that retirees or their spouse may enroll in retiree healthcare coverage, even if they did not initially enroll when first retired. These changes are also necessary for the in-lieu premium credit in the Framework to be effective. This was also a recommendation from the City Auditor in June 2009.
- Pensionable Compensation – The same 2009 report by the City Auditor recommended an amendment to the Municipal Code to ensure that pension calculations include only items that are specifically negotiated and defined as pensionable in the Municipal Code for the Federated Retirement Plans.
The bargaining groups have also agreed that under the City’s discretion, Tier 2 Federated employees will be taken out of the retiree healthcare benefit prior to the VEBA plan being in place.

Report and recs on impediments to fair housing
As recommended by the Neighborhood Services and Education Committee on April 13, 2017, accept the draft Analysis of Impediments to Fair Housing Choice. The purpose of the AI is to provide an overview of the laws, policies, and practices that may hinder residents’ ability to choose housing in the City. It also includes recommended actions to overcome those impediments.
Based on the data presented, as well as the community feedback gathered from 2014 through 2016, the City has identified four factors as the most significant impediments to fair housing in San Jose. These factors, as well as the strategies designed to mitigate those impediments, are listed below.
- The availability of affordable units in a range of sizes.
- Location and type of affordable housing.
- Displacement of residents due to economic pressures.
- Lack of tenant eviction protection and tenant education

Approving $200K agreement w/ Kimley Horn for related to rezoning Moffett Park Specific Plan in order to sell and redevelop the former Onizuka air force station property
Staff are recommending that Council authorize the City Manager to enter into an Agreement with Kimley Horn in an amount not-to-exceed $200,000 for environmental consulting services related to the Amendment of the Moffett Pak Specific Plan to Rezone 1050 & 1060 Innovation Way (former Onizuka air force station) and approve a budget modification in the amount of $200,000 for updated appraisals and environmental review.
The amendment to the Moffett Park Specific Plan will look at removing the restriction on the use of the development reserve with the current zoning of Moffett Park Industrial zoning district (MP-I) and will also examine amending the land use designation and zoning to Moffett Park-Transit Oriented Development zoning district (MP-TOD). MP-I has a base zoning of 35% FAR with potential for 50% and 60% FAR, based on green building achievements. MP-TOD has a base zoning of 50% FAR with potential for 70% and 80% FAR based, on green building levels.
Staff will coordinate with the selected real estate consultant (TBD based on upcoming contract award) to determine the best way to market the property. The real estate consultant will also advise the City regarding the benefits of proceeding with the amendment and increasing the FAR and the possible concerns with delaying the sale until the process is completed. If the City moves forward with consideration of the amendment (once the environmental is completed) it would first go to Planning Commission and then City Council for consideration.
