San Jose Neighborhoods Commission will discuss Crime-Free Multi-Housing proposal by Council Members Khamis and T. Nguyen; would evict residents for any violation.

On October 7, 2015, the Rules Committee referred the proposed Crime-Free Multi-Housing memo to the Council’s Neighborhood Services and Education Committee for future action, and to the Neighborhoods Commission to discuss the possibility of engaging in public outreach around this topic.

The Neighborhoods Commission discussion should focus on the following:

  • Options for outreach (i.e. a public hearing at a Neighborhoods Commission meeting, multiple meetings in the community, etc.)
  • Recommendation to the Committee about the type of outreach the topic warrants
  • Impact on the Neighborhoods Commission’s adopted work plan should the Commission take on the recommended outreach.

Mayor Liccardo recommends to keep $1000 minimum penalty for late contribution filing violations; Council Member Jones calls to eliminate it

Due to the large number of violations in the 2014 election, the Ethics Commission reviewed the Municipal Codes that govern elections. The Commission has made recommendations on what should be included in the disclaimer on electioneering communications, deadlines to close out campaign committees, contribution limits, and minimum penalties.

Mayor Liccardo and Council Member Jones each introduced a memo which included recommendations on the issue of penalties.The memo from Council Member Jones makes recommendations that include eliminating the minimum penalty for late contributions. The memo from Mayor Liccardo makes recommendations that include mandating a minimum penalty of $1000 for failure to file late contribution reports, but allow the Commission to reduce the penalty upon making written findings of unusual mitigating circumstances that make a $1000 fine unreasonable.

The Ethics Commission recommends that the minimum penalty of $1,000 for failure to file late contribution reports be eliminated.

City of Sunnyvale

Discussion and Direction on Study Issue and Report Related to Car/Ride Share Impacts on Taxicab Franchises and Review of Taxicab Franchise Regulations.

The firm Harvey M. Rose Associates was hired to conduct a study on the impacts of TNCs (Transportation Network Companies) on taxicab franchises. Council will discuss the study results and may give direction on any of the recommendations suggested by the study.

Key findings of the report include, but are not limited to:

  • There have been some downtrends in the City’s taxi industry since the introduction of TNCs; however, there is no empirical evidence to support a direct causal relationship between the establishment of TNC services and a drop in taxi fee revenues
  • There are more barriers and costs to becoming a taxi driver than there is to becoming a TNC driver
  • To operate in more than one city, taxi franchises must be licensed by multiple jurisdictions; the various barriers and costs associated with that requirement result in a greater regulatory burden on taxi franchises
  • A comparison of the City’s taxi fees and regulations with neighboring cities indicated some inconsistency in certain areas, particularly with regard to vehicle inspection fees. Sunnyvale has higher fees than neighboring cities.

Other local jurisdictions in California have either conducted or are continuing to conduct a review of their taxicab rules and regulations in response to the impact of the TNC industry.

City of Palo Alto

Minimum Wage

The City will have their second reading of their adoption of an ordinance adding Chapter 4.62 to Title 4 (Business Licenses and Regulations) of the Palo Alto Municipal Code to adopt a citywide minimum wage for Palo Alto employees.

The ordinance will increase Palo Alto’s minimum wage to $11.00/hour, and increase it each following year by tying the annual Cost-of-Living Adjustment (COLA).

West Valley Mission Board of Trustees

Recruiting candidates for appointment to vacant Board of Trustee seat

The Board is recruiting candidates for appointment to the vacant area 4 Board of Trustees seat due to the resignation of Trustee Nick Heimlich who moved outside of the Area 4.  Board of Trustees announced that it will fill his seat until the next general election in November 2016 through a provisional appointment process in accordance with Education Code Section 5090, et seq.

Interested candidates must meet the following minimum qualifications to be considered:

  • Must be 18 years of age.
  • Must be a registered voter.
  • Must reside within the West Valley-Mission Community College District, Trustee Area 4.
  • The selected candidate cannot be an employee of the West Valley-Mission Community College District while serving on the Board.

East Side Union High School District Board of Trustees

Discussing policy for charter renewal

The board will conduct a discussion and/or action of district board policy for charter school renewal and the recommended renewal protocol.  Glenn Vander Zee, Assistant Superintendent of Educational Services, Kirsten King, Director of Assessment & Accountability, and Lucretia Peebles, Ph.D., Administrator for Charter School Oversight will be in attendance.

This item is an overview of charter school renewal policy as delineated in the ESUHSD Board Policy 0420.42. Renewals are “governed by the standards and criteria” in Education Code 47605. This item also provides a review of recommended (or optional) charter renewal protocol.

County Of Santa Clara

County of Santa Clara: Full technical study of Community Choice Energy district to include 10.

Last October, the County of Santa Clara joined the Cities of Cupertino, Mountain View, and Sunnyvale in a partnership to study the potential to form a community choice aggregation (CCA) district.  Through joint powers authorities, CCA districts procure clean energy at rates competitive with the relevant investor-owned utility (in this case, PG&E) for energy consumers in partner jurisdictions.

Benefits of a CCA District include:

  • Increased share of clean energy resources
  • Increased greenhouse gases reductions
  • Acceleration of Climate Action Plan and State of California energy and GHG reduction goals
  • Local control and local energy efficiency program benefits
  • Enhanced local economic stimulus

This report summarizes the provisions of both the Full Technical Study and the Draft Joint Powers Authority Agreement. In addition to the Sponsoring Partners, the following municipalities have joined the technical study: The Cities of Campbell, Gilroy, Los Altos, Los Altos Hills, Monte Sereno, Morgan Hill, and Saratoga.
