SAN JOSE

 Reed, Liccardo, Khamis plan to delay Measure B

 As outlined in the memo from Reed/Liccardo/Khamis & recommended by Rules on Sept. 10, direct the City Manager to begin negotiations with the Police Officers Association and other applicable bargaining units to:

(a)    Enter into a stipulation to defer the implementation of the portion of Measure B that calls for employees to make an additional 4% contribution of salary to the Police & Fire and Federated retirement plans or take a 4% reduction in pay, for at least an additional year beyond July 1, 2015, the expiration of the existing stipulation; and

(b) Create a Patrol Staffing Retention Plan to allow officers with 25 years or more of experience to remain in a paid position on the force, in patrol, while receiving a distribution of pension benefits in some form. Such a program must avoid the large liabilities created by guaranteed rates of return in may “DROP” programs, and ensure that officers who remain on the force do so at a rank of officers or sergeant, serving in a patrol responsibility..

Currently the city is looking for volunteers to fill the following commission seats:

Council Appointment Advisory Commission (4 seats):

  • Council Nominated Seats (Districts 3, 8, 10 and citywide)

Housing and Community Development Commission (3 seats):

  • 1 Council Nominated Seat (District 7): seat recommended to be filled as a low-or moderate income representative
  • 1 Mobile Resident Seat
  • 1 Mobile home Landlord Seat

Human Services Commission (4 seats)

  • 3 Council Nominated Seats (Districts 2, 4, and 8)
  • 1 Disability Provider or Disabled Community Representative Seat

Use of Police Reserves

  The recommendation is to accept the report on the Use of Police Reserves as referred by the Public Safety, Finance and Strategic Support Committee on May 15, 2014. During last month’s committee meeting there were some concerns regarding the use of police reserves and the need to update the San Jose Municipal Code Chapter 8.12, which establishes the San Jose Police Reserve.  Some of the concerns included; whether reserve officers are covered by State worker’s compensation laws when they are performing their monthly volunteer services; personal liability arising from their service as reserve officers; and to whether the Municipal Code needs to reference specific states statutes applicable to the peace officer duties, functions and qualifications of police reserve officers.

Request for report on Police performance

Councilmember Rocha memo recommending that Rules direct staff to prepare a written report on Police Department operations and performance. It is requested that the memo/report includes information on Police Department staff, Rules Committee members and the following issues: current status of police department sworn staffing including current staffing levels, any projections as to future staffing, and update on recent academy class size; and analysis of recent trends in crime statistics including, overview of deployment strategies, a discussion as to whether these deployment strategies entail tradeoffs, use of overtime, and to discuss lower priority crimes and how they reflect on the city statistics.

Minimum Wage ordinance

Tentatively agendized for Oct. 14: Introduce an Ordinance to Create Chapter 3.70 (Minimum Wage) of Title 3 of the Sunnyvale Municipal Code to Require Businesses to pay a Citywide
Minimum Wage.

Local Hiring and job standards on major development

Tentatively agendized for Nov. 11: Examine Ways to Increase Local Hiring in Major Developments. This will be the staff report and recommended next steps on the Study Issue introduced last December
