Cooking On-Site for Senior Nutrition Program

Council will vote on a resolution that will  provide on-site cooking services at 11 of the 13 City nutrition sites while continuing to deliver meals to Camden and Alviso Community Centers. The catered model will be provided October through December 2014, and cook on-site January through September 2015 by Bateman.  Hopefully with less salt added to the food.

Implementation of Changes to Retiree Healthcare Funding 

To be heard: October 7, 2014 

City council will Adopt a resolution to approve the terms of agreements that would modify retiree healthcare funding effective December 21, 2014 by extending the phase-in of the retiree Annual Required Contribution through June 21, 2015.

Authorize the City Manager to execute said agreements, pending ratification by their memberships:

  1. Association of Building, Mechanical and Electrical Inspectors (ABMEI)
  2. Association of Engineers and Architects, IFPTE Local 21 (AEA Units 41/42 and 43)
  3. Association of Legal Professionals (ALP)
  4. Association of Maintenance Supervisory Personnel, IFPTE Local 21 (AMSP)
  5. City Association of Management Personnel, IFPTE Local 21 (CAMP)
  6. Confidential Employees’ Organization, AFSCME Local 101 (CEO)
  7. International Brotherhood of Electrical Workers, Local No. 332 (IBEW)
  8. Municipal Employees’ Federation, AFSCME Local 101 (MEF)
  9. International Union of Operating Engineers, Local 3 (OE#3)

Determining whether to place medical marijuana zoning initiative on the ballot; San Jose

To be heard:  Sept. 30, 2014

Proponents have collected enough signatures to place on the 2016 San Jose ballot an initiative petition to include medical marijuana collectives as an allowed land use in agricultural, commercial pedestrian, commercial neighborhood, industrial park, light industrial and heavy industrial zoning districts, and to establish a registration process and zoning code verification certificate process.  On Sept. 19, the Santa Clara County Registrar of Voters certified the signatures. The City Council must make a determination of how to proceed within ten days of notice of the certification. The Council must take one of 4 actions:

(1)  Order a report on the effects of the proposed ordinance to be presented to the Council no later than October 30, 2014, following which the Council must either adopt the ordinance within 10 days or order an election; or

(2) Adopt the proposed ordinance as submitted no later than October 10, 2014; or

(3) Adopt a resolution no later than October 10 to submit the initiative to the voters at a Special Municipal Election on a date to be decided; or

(4) Adopt a resolution no later than October 10 to submit the initiative to the voters at the next General Election on Tuesday, June 7, 2016.

REQUIRES A DETERMINATION BY A TWO-THIRDS (2/3) VOTE OF THE MEMBERS OF THE COUNCIL PRESENT AT THE MEETING, OR, IF LESS THAN TWO-THIRDS (2/3) OF THE MEMBERS OF THE COUNCIL ARE PRESENT AT THE MEETING, A UNANIMOUS VOTE OF THOSE MEMBERS PRESENT THAT THERE IS A NEED TO TAKE IMMEDIATE ACTION. Council’s Rules of Conduct, Resolution No. 77136, Rule 3(d) (8 votes required).
