SB 3 – Minimum wage fairness act vote

SB 3 will raise the state’s minimum wage to $11 per hour on January 1, 2016; to $13 on July 1, 2017; and beginning on January 1, 2019 and every January 1 thereafter, the minimum wage would be adjusted by the California CPI to keep pace with inflation.

SB 3 has been assigned to the Senate Labor and Industrial Relations Committee with no date set yet for hearing. City Council may vote on supporting SB 3.

Superior Court finds that San Jose general plan does not comply with CEQA

Issue summary: On January 27, 2015, the Superior Court of California issued an order finding that the Envision San Jose 2040 Program Environmental Impact Report (EIR) does not comply with the California Environmental Quality Act (CEQA) related to the EIR’s analysis of greenhouse gas emissions. This resulted in all use of the General Plan EIR as environmental clearance for pending projects to be suspended. The City Planning CEQA staff has been working to comply with the Court order.

Family Friendly workplace certification

Issue summary: The Board of Supervisors, at its meeting on May 20, 2014, directed the Administration to develop a County Living Wage Ordinance and an Employer Certification Program that would acknowledge those businesses that are helping the County of Santa Clara fulfill its public goals in the areas of fair compensation, health and health care, and equal opportunity in the workforce.

Independent of the Board’s referral in May, the Office of Women’s Policy (OWP) and the Commission on the Status of Women (CSW) partnered in 2014 with the Santa Clara County Workplace Collaborative to develop an employer program that recognizes local businesses and organizations that provide their workers with comprehensive stability, including but not limited to, scheduling and leave policies that support the health of workers and those they care for, protections against wage theft and retaliatory employment practices, and a recognition of rights of parents and mothers in the workplace.

Because low wages are not the only feature of a job that drives families into poverty, and increasing wages alone is insufficient to achieve the desired impact of a living wage ordinance, the Family Friendly Workplace Award provides an incentive to businesses to create jobs that help local families achieve economic self-sufficiency. The “Family Friendly Workplace Award” developed by OWP and the CSW is for employers of any size located within the geographic boundaries of Santa Clara County, and highlights criteria in three policy categories that have a high impact on employees:

· Work – Family Balance

· Pregnancy and Parenting Leave and Accommodations

· Lactation Accommodations

The proposed award is based on a three-tier – bronze, silver and gold – standard, and the award level is determined from a simple, one-page employer self-assessment[1].  Employers would apply for the award based on the self-assessment .  Supporting documentation would be requested to substantiate the self-assessment.  The nomination period would be from May through August and recipients would be acknowledged at the CSW Women’s Equality Day event in August.  All award recipients would receive a digital seal for their website and marketing purposes as well as a certificate.  The Family Friendly Workplace Award would be conferred annually to recognize Santa Clara County employers.

The Family Friendly Workplace Award application will be available on the OWP website and can be completed online or downloaded, completed, and returned to the Office of Women’s Policy.  Also online will be the “Family Friendly Workplace Awards Toolkit for Employers and Employees.”  All nominations must be received by 5 p.m. on Friday, August 14, 2015 for consideration.  OWP Staff and members of the SCC Workplace Collaborative will review the applications and those that meet the requirements will be honored at the annual CSW Women’s Equality Day luncheon on Friday, August 28, 2015.  The SCC Workplace Collaborative will assess the 2015 process and make any improvements for subsequent awards.  Employers are encouraged to apply annually for this certification.

Trustee Beauchman to retire

Issue summary: Santa Clara County Board of Education, Area 3 Trustee, Leon Beauchman, tendered a letter of resignation to the County Superintendent on February 20, 2015.  Board member Beachman’s resignation will take effect on March 31, 2015.  Given board member Beauchman’s resignation, the Board must now determine how the vacancy will be filled.  Administration recommends establishing the selection committee and determining first meeting of that committee or directing the County Superintendent to proceed with the formality of ordering a special election.

Draft Time Line for Provisional Appointment includes applications to be submitted by April 3. On April 15th Process committee will meet to screen applicant selection and determine candidates to be interviewed.
