Referral to ban City travel to Indiana

City of San Jose Actions in Opposition to State of Indiana’s Religious Freedom Restoration Act.

Consider a recommendation to the City Council to direct the City Manager to expedite the preparation of a resolution with the following goals:

a. Ban all City travel and business with the State of Indiana unless the State through legislative or executive action repeals the Religious Freedom Restoration Act;

b. Ban travel to any other State which passes similar legislation;

c. Call on Governor Brown and California Legislature to follow the lead of other States and a number of other California municipalities and corporations in condemning the actions of the State of Indiana.

$3M expansion of the Sharks Ice Center to facilitate addition of minor league hockey team

Issue summary: In January 2015, the American Hockey League (AHL) announced the formation of a minor league Pacific Division for the 2015-2016 season. This new division will be composed of existing AHL teams relocated to California. The teams are all affiliates of teams in the NHL’s Pacific Division. The San Jose Sharks have a minor league AHL team that they intend to relocate to Sharks Ice.

The proposed actions will facilitate the addition of an AHL, AAA (minor league) team at the SAP Center. The AAA team will commence play of 30-35 games in September 2015. The recommendation is to adopt a resolution: consenting the use of the SAP Center as a regular home game facility by the AHL; to approve an agreement for the Third Expansion of the Ice Center by and between the city and Sharks Ice, LLC, providing for the construction of a two-story expansion to the Ice Centre by 6,800 square feet for a private locker room and related facilities for the AHL team, at no cost to the City; and approve the third Amendment to the Amended and Restated Lease and Management Agreement for the Ice Centre to add the expansion area to the lease and to allow the AHL team use of the private locker room and related facilities for its training and practice sessions including use of the Ice Centre’s ice rinks.

Sharks Ice estimates that the project cost will be approximately $3,000,000 including all hard and soft costs, furniture, fixtures, equipment and contingencies. The expansion project will eliminate approximately 5 parking spaces adjacent to the Ice Centre, but does not reduce the minimum 714 spaces allocated for the Giants use of the parking lot.

 Milpitas

 Receive solid waste program status report

Public entity:   Milpitas City Council

Issue summary: The City of Milpitas entered into a trash and recyclables hauling contract and a disposal contract with Browning Ferris Industries (BFI) in 1986, and entered into a residential yard waste hauling contract with BFI in 1996. Republic Services is the successor corporation to BFI and currently provides these services. All contracts will expire on September 5, 2017. It is in the best interest of the City to

pursue a competitive bid and immediately commence with the process for a new contact. A Request for Proposals (RFP) process will provide for a competitive procedure ensuring the best value and service to the community.

The City has retained the services of HF&H Consultants, LLC to assist in the procurement of a solid waste services vendor. The process includes identifying proposed levels of service, ability to add services to keep in compliance with changing regulations, establishing criteria for evaluation, issue the request for proposals, proposal evaluation, award, community outreach, and implementation phase. The entire process is estimated to take 30 months. A schedule is included in the Council packet.

The next steps include presentation of a proposed Request for Proposals (RFP) process Integrity Policy and a Council Workshop. The proposed Policy, tentatively scheduled for the April 21 Council meeting, is necessary to insure that all vendors have the same information when preparing their bids. The Council workshop, tentatively scheduled for early May, provides Council with the opportunity to establish service goals, contract structure, key business points, and policies.

All improvements to be constructed at the Ice Centre will be borne by Sharks Ice, including an estimated amount of $128,000 paid by Sharks Ice for the Public Works staff to review, approve and inspect the project.
