Recommendation to adopt City-wide minimum wage of $10.30 effective July 1, 2015 and to be adjusted annually by CPI increases every January 1st. If adopted, compliance and enforcement could be a coordinated effort with the City of San Jose Office of Equality Assurance (OEA). Based on analyses released during the City of San Jose’s deliberation of a similar ordinance, the increased minimum wage would have limited negative impacts on business expenses and costs to consumers; and positive impacts on the economy.

The ordinance also prohibits retaliation or discrimination against any individual seeking to enforce its terms and includes the right for employees to pursue a civil action to recover back wages and to seek reinstatement. The City would be authorized to issue administrative citations and monetary fines; conduct administrative hearings; and seek injunctive relief against noncompliant employers.

Updates & next steps on minimum wage goal of $15/hr

On October 28, 2014, Council adopted a Minimum Wage Ordinance for the City of Sunnyvale. In addition, Council directed staff to work with neighboring cities, specifically the City of Mountain View, and regional organizations with the goal of reaching a $15/hr minimum wage by 2018.

In the three months that the ordinance has been in effect, two formal complaints have been received. One complaint was deemed unsupported as the investigation found no violation. The other complaint was determined to be a minimum wage violation and staff is in the process of determining the amount of back wages owed.

Staff in Palo Alto, Campbell, and Santa Clara are exploring a minimum wage increase similar to the increase approved/adopted in San Jose, Mountain View, and Sunnyvale. The City of Campbell has a study session planned for May 2015 to discuss the minimum wage issue. Palo Alto and Santa Clara may introduce a minimum wage ordinance by summer 2015.

So far, Mountain View has been the only city to express formal support for the $15.00 by 2018 goal. On March 31, 2015, Mountain View City Council directed its staff to work with Sunnyvale staff, and other cities, on a regional goal of reaching $15.00 by 2018. Sunnyvale staff, in cooperation with staff from Mountain View, will present a report to Council with the feedback received from other cities, the public, and the business community by late Nov/early Dec 2015. Staff will also present Council with options for a new ordinance to increase the City’s minimum wage to $15.00 by 2018.

Employment schedule and pay improvements

To be heard:  April 21, 2015 7:00pm

Issue summary: Presentation of articles to be opened for negotiations. Employee Association proposals include: workers will receive District paid health benefits for up to one year; step increase—decreasing the time between steps and increasing the number of steps, and: Using classified employees to fill temporary positions, by lateral or working out of class, before the District can hire a temporary employee. 

District proposals include: Salaries and Compensation—proposal for a salary enhancement to be added to the salary schedule in 2015-2016 and changes to Classification System regarding the process for reclassification requests and the general provisions for the process.

Health and Welfare: Changes to the language regarding verification of domestic partnership and enhancement of dependent coverage to comply with state law and regulations; Incorporation of language from Sideletter #8 incorporating benefit and eligibility criteria for retirees hired on or after July 1, 1994 and retiring on or after January 1, 2015.

Work Assignments and Hours: Increased hours of “work week”; Insertion of language on decisions to discontinue “alternate work schedules.”  Public comment on the proposed re-openers and proposals, after which the Board will vote to “adopt” these proposals.
