Issue summary:  At the Board meeting on April 7, Supervisors Chavez and Wasserman directed Administration to report to the Board of Supervisors through the Finance and Government Operations Committee with an asset map identifying all land owned by the County, the Destination: Home inventory of publicly-owned land when it is available, a process and a framework to evaluate the County’s land holdings, and a process to recognize opportunities to purchase land from willing sellers.

Asset Map of County-owned Land: The Administration will provide the asset map of County-owned property to the Board, through the Finance and Government Committee, within 60 days.

The Administration is able to identify approximately 740 County asset parcels. Some of the information related to these parcels dates back through the 1980s necessitating research to clear titles and properly define County departmental ownership and responsibility. A map of surplus assets as agreed upon by departments is attached to this report. The Administration will continue work to assemble a complete Land Asset Map to be delivered to the Board at a later date. This product would be a complete Land Asset Map in a dynamic interactive digital format utilizing GIS.

FY 2015-16 Budget hearings and adoption

Issue summary: The Board of Supervisors will hold Budget Hearings on June 15, 16, 17 and 19, finalizing adoption of the FY 2015-2016 budget on June 19.

Highlights:

  • June 15, item 11: Consider Inventory Item No. 14 relating to allocating $100,000 in one-time funding to support diabetes awareness and screening efforts. (Yeager/Cortese) Includes $75,000 for an Awareness Campaign & $25,000 for Prediabetes/Diabetes Screening Effort.
  • June 16, items 57-58: Allocate $405,000 from the General Fund to Law Foundation of Silicon Valley, Catholic Charities, Community Legal Services of East Palo Alto, the Katherine and George Alexander Law Clinic, and the Step Forward Foundation to provide immigration legal services to unaccompanied minors and families with children; and allocate $1,080,000 relating to Agreement with Silicon Valley Community Foundation, to implement the Santa Clara County Immigrant Family Referral Plan.

San Jose

Salary increases for Mayor to $125,000 per year; for Councilmembers to $92,000 per year

Issue summary: Approving an ordinance to set the salaries and benefits of the Mayor and City Council for the next two Fiscal Years.

The Mayor’s salary would be increased to $125,000 annually, and Council salaries would be increased to $92,000 annually. Vehicle allowances would increase to $500 per month. In addition, a resolution would increase the stipend for non-City employee members of the retirement boards to $225 per monthly meeting.

These salary and stipend increases are intended to recognize the full-time nature of the position, as well as the authority and responsibility of the positions. The Salary Setting Commission recommends these salary increases in spite of the City’s ongoing budget issues and economic challenges in light of the slow recovery of the economy; and the workload, complexities, challenges, and time commitments of the positions.

The retirement board stipend increase is recommended to acknowledge that the stipend has not increased since 2003.

Council Priority Setting Session, possible issues include wage theft. local hiring & apprentice utilization, exempting hotels from alcohol permit requirement, land use regs for school development & more

Issue summary: Council to approve and rank new items for the Priority List.

In addition to items currently on the list and those new items nominated by City staff, departments, following are the new items that have been nominated by Councilmembers:

Councilmember Kalra:

  • Wage Theft, Part B, which will supplement the increase of the minimum wage by enforcing existing labor laws and protecting employees from wage theft
  • Local Hiring/Local Business/Apprenticeship Utilization Program, which will create policies to encourage the hiring of local workers and contracting of local and small businesses to address the growing income inequality gap.
  • Green Leaf Blower, which will require the conversion of all leaf blowers from gas powered to electric, with potential funding from the California Air Resources Board

Mayor Liccardo:

  • Prohibition of the Obstruction of Sidewalks without a Permit, which would require contractors to provide alternate routes if they block sidewalks, and insure contracts share liability for sidewalk obstruction with contractors during construction projects
  • San Jose is Open for Business program, which would provide businesses with options for resolving conflicts when applying for a permit from the Building Department; in addition, exempts mid-size and large hotels (75 rooms or more) from Conditional Use Permit requirements for serving alcohol

Councilmember Rocha:

  • A dual plumbing ordinance to facilitate recycled water use, which would require new non-residential development to be built with dual water plumbing systems
  • Prohibit Tobacco Sales to Persons Under 21
  • Land Use Regulations for New School Development, which would provide a framework for evaluating concerns surrounding new school development, such as provision of adequate recreational and facility space, traffic circulation, and compatibility with surrounding areas
  • Allow Non-Commercial Users at Recycled Water Fill Stations, which would make recycled water available to residents at water fill stations

Councilmember Peralez:

  • Adopt Sustainable Development Goals, to analyze and make recommendations for a process through which Council can authorize the adoption and implementation  of the UN Sustainable Development Goals
  • Requirements for Storefront Activation in Downtown San Jose, which will implement penalty fees for inactive storefronts and require all new downtown core development to have mandatory activation of ground floor space or storefronts

Vice Mayor Herrera: Allowing secondary detached units in San Jose, which will modify the Municipal code to allow and facilitate the building of secondary detached residential units on residential parcels.

Councilmember Jones: Creation of a pilot program to analyze and evaluate the economic impact of converting employment land to other purposes, which is intended to explore the potential of converting that land to its highest and best use to positively impact the City’s financial health.

Councilmember Khamis: A revision to the Fireworks Ordinance of San Jose to develop a schedule of administrative fines for illegal firework usage and to allow for the issuance of fines by firefighters and park rangers.

Councilmember Oliverio:

  • Director-initiated Rezoning Program, to modify zoning districts on private property to facilitate economic development
  • Newsrack in Business Districts, to provide allowances for newsracks in business districts and address appropriate signage
  • Conservation area ordinance streamlining (Distinctive Neighborhoods), which will create a more efficient process for establishing conservation areas

3 public outreach meetings on proposed City minimum wage

Modifying ENAs and Term Sheets for development of City Place & Tasman Lots by Related and Montana, including over 9M sq ft of hotel, retail, residential & office

Agenda Item Name: Adoption of a Resolution approving the Term Sheet Supplement No. 2 and Amendment No. 2 to the Exclusive Negotiating Agreement with Related Santa Clara LLC for the development of City Place Santa Clara on approximately 230 acres in the North of Bayshore Area and adoption of a Resolution approving the Term Sheet Supplement and Amendment No. 5 to the Exclusive Negotiating Agreement with Montana Property Group for the development of the City-owned Tasman Lots located at the northwest and northeast corners of Tasman Drive and Centennial Boulevard in the North of Bayshore Area.

Issue summary: Since 2013, City Council has approved two Exclusive Negotiating Rights Agreements for the development of two separate projects on City-owned land located north of Levi’s Stadium: one project to develop the “Tasman Lots,” two vacant City-owned parcels located at the northwest and northeast corners of Tasman Drive and Centennial Boulevard, and one project to develop “City Place,” a mixed-use project on 230 acres of City-owned land to the north of the Tasman lots.

In February 2015, the designated developers for these two projects formed a joint venture to develop the Tasman Lots and the City Center portion of the City Place project.

Council approval of the recommended action would 1) modify both Exclusive Negotiating Rights Agreements (ENAs) with their respective developers, and 2) modify and supplement the Term Sheets with each development entity which, set forth the terms and conditions to be fully negotiated and further documented under a Disposition and Development Agreement (DDA), Development Agreement (DA), and Ground Lease (collectively the Transaction Documents) for future City Council approval.

Milpitas

Requiring all new residential development s to include 5% affordable units

Issue summary: Approving a resolution that would require all new residential applications received after June 16, 2015 to include plans for affordable housing units. All completely new residential development applications with 5 or more residential units must provide 5% of very-low or low-income residential units as determined by the City. This requirement can be satisfied by providing affordable units and recording a covenant restricting the units to very low-income or low-income for a minimum period of 55 years; contributing an amount to the City equivalent to 5% of the construction value as determined by the Building Department to be paid at the time of building permit issuance; or a combination thereof.

The amount of in-lieu fee to be paid will be the lesser of either the amount in effect pursuant to the implementing City Council ordinance or resolution at the time full payment is made to the City at the time of building permit issuance, or the amount equivalent to 5% of the construction value as determined by the Building Department.
