Santa Clara County Board of Education: Charter schools update

Twenty-three charter schools authorized by the Santa Clara County Board of Education are in operation in 2015-16.  This includes several new schools and several schools which have faced facility challenges.  The Charter Schools Office has collected enrollment information on each of these schools and has identified several schools which will require staff follow-up.  A summary of this information is presented along with a listing of the charter schools which will come before the Board for renewal in 2015-16.

Councilmembers Khamis, T. Nguyen call for Crime Free Multi-Housing program to be implemented in San Jose; Program would evict residents for any violation

Councilmembers Khamis and T. Nguyen recommend the City Manager report out on progress toward the implementation of an opt-in Crime Free Multi-Housing Program to be supported by the San Jose Police Department, place the item on the October 14 Neighborhoods Commission agenda for review, and place the program’s implementation plan on the October 27th Council agenda.

A number of community organizations strongly oppose the proposal, pointing out that it could result in eviction for arrests that do not result in any conviction, for immigration violations, for victims of domestic violence, for residents who engage in acts of civil disobedience, or a large range of other issues involving contact with the justice system, all at the landlord’s discretion.

Agreement with Taxi San Jose for On-Demand Ground Transportation Dispatch services at Mineta Airport will level playing field with Transportation Network Companies

Recommendation to execute an agreement with Taxi San Jose to provide On-Demand Ground Transportation Dispatch Services at the Mineta Airport. Executing this agreement will allow on-demand dispatch services to continue providing a stable dispatch management program for taxis at the Airport with improved technology, systems, and processes. It will also level the playing field between taxi services and the Transportation Network Company (TNC) industry, which includes companies like Uber and Lyft.

The Airport has established a pilot program for TNCs, however no companies are participating within the program at this time.

Update on Transportation Network Companies (TNC) requirements for airport operations; San Jose may join LA & SF in asking CPUC to require fingerprinting for TNC drivers statewide

Recommended action: Refer to City Council to adopt a resolution to file a motion with the California Public Utilities Commission on behalf of the City to request the requirement that TNC drivers be fingerprinted as a statewide mandate.

The taxi industry has also suggested 3 amendments, they include:

  • All TNC drivers will be subject to random alcohol testing by the TNC and must have been alcohol tested within the past 12 months.
  • All TNC drivers will display evidence and a photograph that the driver has been approved by the TNC that can be seen from outside the vehicle.
  • TNCs may not wait in the cell phone waiting area for engagement.

TNCs have offered varying levels of willingness to comply with currently established requirements.

Liccardo/Jones criticize County’s draft RFP for emergency ambulance services, wants hybrid public-private delivery model

Mayor Liccardo & Council Member Jones released a memo recommending that Council direct the City Manager to continue to work with the County of Santa Clara on their draft Advanced Life Support First Response and Emergency Ambulance Services Request for Proposal (RFP) and communicate the City’s preference for a full and fair evaluation of all delivery models. They further state: On September 16, 2015 the County of Santa Clara released a draft RFP that insufficiently reflected any public input, particularly the strong recommendation of the Santa Clara County Fire Chief’s Association and the Santa Clara County Cities Association to adopt an open and fair process that would include consideration of alternative hybrid (public-private) delivery models. On September 17, 2015 the City Manager wrote the County, sharing the City’s concerns with the draft RFP.

Liccardo/Peralez/Carrasco/Rocha/Khamis MEMO to require cost-benefit analysis, prevailing wage & labor peace in Exclusive Negotiation Agreement (ENA) with Insight Realty for Parkside Hall hotel/residential/office development

City-owned Parkside Hall is located adjacent to the Tech Museum, and has become obsolete due to age and condition, with growing costs to operate and maintain the building and the need in the near future to update the heating and air conditioning system at significant cost.

A memo from Mayor Liccardo & Councilmembers Peralez, Carrasco, Rocha & Khamis requests approval of staff recommendations to select Insight Realty Investments Inc. and to execute an Exclusive Negotiation Agreement. Additional direction includes, but is not limited to:

  • Preparing a Cost-Benefit Analysis explicitly comparing the value of City-owned land to be contributed to the development.
  • Request staff to respond to questions such as: How will the sale price for the property be determined?Are there plans to conduct a residual land value analysis for the project?
  • Requiring the developer to:
    • Provide evidence of the partnership agreement that reveals all of the principal parties;
    • Commit to pay fees or build units on site in the event that the project is deemed to meet the definition of for-sale under the City’s Inclusionary Housing Ordinance;
    • Show good-faith effort to hire local construction trades people;
    • Fully comply with the City’s Prevailing Wage Policy;
    • Facilitate with any potential hotel operator the opportunity to enter into a labor peace agreement; and
    • Participate in the City’s Business Cooperation Program

City of Sunnyvale

 Community meetings & City survey on raising minimum wage to $15

As per Council direction, staff is conducting outreach on the City’s goal of reaching $15 per hour minimum wage by 2018. Two meetings have been scheduled. Both will be held on October 7th in the Council Chambers. The first will be in the morning from 8:30 to 9:30 a.m. with an evening meeting from 6:30 to 8 p.m.

The community can also complete an online survey using Sunnyvale’s Open City Hall. The survey link is available at MinimumWage.inSunnyvale.com.

City of Mountain View

Proposed Fair Rental Practice Program; landlord participation would be voluntary

The Council is concerned that the skyrocketing cost of living is leading to the displacement of many long-term residents or the economically disadvantaged and making it difficult for many to enter the Mountain View housing market either as a renter or a homeowner.

It is recommended that Mountain View create a Fair Rental Practices Program modeled on those of San Rafael and the City of Healdsburg. If this is implemented, landlords wishing to participate in the program would agree to operate according to a set of fair rental practices. Landlords and property owners who participate in the program would be listed on the City’s website, which would also identify those landlords that have fallen out of the program due to noncompliance.

Approving discussions with Robert Green Company for development of City-owned Hope St. lots, including office, retail & hotel operated by Joie de Vivre

 In 2014, Council received unsolicited development proposals for various City-owned property, and discussed pursuing leasing and development of various downtown City parking lots. Initial focus is on the Hope Street parking lots, and staff was directed to market RFQs and RFPs with a preference for a unique hotel of at least three-diamond quality and potentially including a modest retail or office component.

Two proposals were received, from The Robert Green Company and R.D. Olson. R.D. Olson did not meet the labor provisions of the RFP. In addition, staff believes the proposal from The Robert Green Company better meets the objectives of the proposed Hope Street lots development and has more realistic financial projections with higher long-term annual revenues (after Year 20), and a superior, higher-quality site plan concept.

Based on proposal evaluations, staff recommends the City continue discussions with The Robert Green Company.  Staff is not proposing that an Exclusive Right to Negotiate Agreement (ERNA) be executed at this time.

City of Milpitas

Mayor Esteves Requests Gender and Ethnicity Pay Equity Study of City and its Contractors

Mayor Esteves requested that the need for a Gender and Ethnicity Pay Equity Policy or ordinance be researched. This study would include both the City as an employer and the agencies, firms, and businesses the City contracts with to ensure fairness and equity in all contracts. This has not been an issue internally with the City due to current hiring and wage practices, but it is unknown regarding the entities with which the City contracts.

The study will also include researching any necessary actions by the City of Milpitas to ensure compliance with SB 358, which seeks to insure gender wage equity.
