San Jose is considering recommendations related to the agreement with Taxi San José for the On-Demand Ground Transportation Program

It is recommended that Council accept the report regarding citywide taxicab regulations and operations of taxicabs and Transportation Network Companies (TNCs) at the Airport, as recommended by the Transportation and Environment Committee on Oct. 5, 2015.

Update on Transportation Network Companies (TNC) operating plan at the Airport; recommendation that motion be filed with California Public Utilities Commission (CPUC) to require fingerprinting of TNC drivers

Since the August Transportation and Environment Committee meeting, an additional memo was written by Vice Mayor Herrera and Councilmembers Rocha, Khamis, and Peralez. This memo directed staff to evaluate and recommend any changes to Title 16 and Title 25 of the Municipal Code in an effort to provide consistency and balance between the taxi industries and TNCs.

Five of the eight suggested adjustments are already included in the Airport Ground Transportation Permit or the TNC Management and Operating Plan, including requirements to pay all fees and fines, fully comply with the GT Permit, fingerprinting for background checks, vehicle inspections, and business tax license requirements.

The three items recommended by the taxi industry, but not included in the existing permit language are:

  • All TNC drivers will be subject to random alcohol testing by the TNC and must have been alcohol tested within the past 12 months.
  • All TNC drivers will display evidence and a photograph that the driver has been approved by the TNC that can be seen from outside the vehicle.
  • TNCs may not wait in the cell phone waiting area for engagement.

It is also recommended that the City authorize the City Manager to file a motion with the California Public Utilities Commission (CPUC) requesting the CPUC require fingerprinting of TNC drivers as a statewide mandate as part of its next phase of TNC regulation review, similar to the motion filed by Los Angeles.

Charter Review Committee to analyze at-large Council elections system and make recommendations regarding other city election systems

The City Council will consider the approval of the creation of a Charter Review Committee which will analyze:

  • The manner of electing Members to the City Council
  • City Council compensation
  • Whether other Charter elements are no longer in compliance with current laws or best practices

Historically, reviews of the Charter have been conducted by a Charter Review Committee consisting of 15 members. The deadline to apply for the 15 Member Committee is Wednesday, November 11, 2015 at 5:00 pm and interviews to be held at the City Council meeting of November 17, 2015.

Agreement with Silicon Valley Community Foundation for City’s participation in Housing Nexus study

The Silicon Valley Community Foundation (SVCF) is leading a multi-jurisdictional effort to develop a nexus study and feasibility analysis of the potential of an impact fee or linkage fee associated with development for affordable housing.

Staff recommends that Council approve Santa Clara’s participation in this nexus study, and authorize the City Manager to enter into the necessary funding agreement.

 Mountain View considering minimum wage ordinance to reach $15 by 2018

In March 2015, Council approved a work plan for reaching a minimum wage of $15 by 2018:

In August 2015, the City of Santa Clara adopted a minimum wage ordinance based on the San Jose/Mountain View/Sunnyvale ordinance with one difference—the minimum wage was raised to $11.00 instead of $10.30. Shortly thereafter, Palo Alto also adopted $11.00 minimum wage ordinance.

Adopting urgency ordinance to require landlords to provide tenants with written 6-month or 1-year leases

In response to testimony presented to the City Council by renters regarding rental increases and tenant evictions, the Council held a Study Session in October 2015. After hearing more comment and testimonials, Council directed staff to draft an urgency ordinance requiring landlords to provide tenants with a 6- or 12-month written lease and also to provide tenants with 90 day written notice of any eviction notice or rent increase. In addition, the Council directed staff to prepare recommendations for a mandatory mediation program for rental disputes, and to work with Community Services Agency to enhance the emergency assistance to renters.

The urgency ordinance will remain effective for 90 days to allow a regular ordinance to be adopted.

Council study session on transportation strategies, including fixed rail, development plans & on-demand services

The City Council adopted three new major goals and accompanying projects for FY 2015-16 and 2016-17 with a goal to improve transportation by enhancing mobility and connectivity.  In recent years, the City Council has made efforts to identify and begin implementation of transportation improvement strategies to respond to current and anticipated growth and development in the community/region.

Staff is requesting direction on:

  • How much emphasis should be placed on a variety of last-mile transportation connection modes vs. focusing more specifically on fixed-rail options?
  • Which last-mile transportation connections/transportation modes should be evaluated?
  • Which transportation corridors/connections/destinations should be included in the evaluation?

West Valley-Mission Community College District

Board to make provisional appointment for vacant Trustee seat; applications due Oct. 30 2015

Due to the resignation of Trustee Nick Heimlich, the West Valley-Mission Community College District (WVMCCD) Board of Trustees announces that it will fill his seat until the next general election in November 2016 through a provisional appointment process.

Applications must be received in the Office of the Chancellor not later than 5:00 p.m. on October 30, 2015.  The Board will conduct interviews at a public Board meeting during the week of November 9, 2015. The Board will make the provisional appointment at its regular meeting on November 17, 2015.
