Consider recommendations related to the Silicon Valley/Alameda County Nexus Study Project

To enact an affordable housing impact fee, jurisdictions must first conduct a nexus study to demonstrate how market-rate housing or commercial developments create the need for the affordable housing. To conduct a nexus study a city or county would typically hire a consultant on its own.  A better alternative is to collaborate with other jurisdictions to save time and money, as well as providing a stronger basis to support the likely policies that will need to be adopted.  Jurisdictions in Santa Clara and Alameda counties are interested in coordinating their efforts.  The Silicon Valley Community Foundation is leading the effort and they have contracted with Keyser Marston Associates, an experienced nexus study firm, to complete the nexus study.

Proposal for health coverage program for the remaining uninsured

 

Working Partnerships USA, Santa Clara Valley Health & Hospital System and CHP received a $200,000 planning grant from the Blue Shield of California Foundation to develop a coverage program for the residually uninsured in Santa Clara County.  The shared goal is to cover the approximately 54,000 residually uninsured patients currently receiving care within our safety net system.

Convening General Plan 4-Year Major Review Task Force

In November 2011, City Council adopted the Envision 2040 General Plan, which charts an ambitious path to achieve the shared vision for a thriving and sustainable community. The General Plan established a 4-Year Major Review cycle, which gives the Council an opportunity to assess progress towards the achievement of economic, environmental, fiscal, and other goals.

Taxicab industry requests amendments to San Jose Municipal Code regarding fare setting

The Department of Transportation is supportive of the concept of providing more flexibility to the taxicab industry; however, it is important to note that the current methodology of setting taxicab rates has been designed to be efficient and requires limited staff resources to maintain/change.

Airport staff agrees with the taxicab industry that Transportation Network Company drivers should also present a photo ID within their vehicle in the same manner as a taxi driver. However, no further changes to ID requirements of Transportation Network Companies are recommended unless they are also applied to the taxi industry.

Update on Transportation Network Companies operating plan at San Jose Airport

Since the August Transportation and Environment Committee meeting, an additional memo was submitted by Vice Mayor Herrera and Council Members Rocha, Khamis, and Peralez, directing staff to evaluate and recommend changes to Titles 6 and 25 of the Municipal Code in an effort to provide consistency and balance between the taxicab industry and Transportation Network Companies.

The taxi industry has recommended changes to the Transportation Network Companies Management Operating Plan, including requiring random alcohol testing of Transportation Network Company drivers, which taxi drivers are not subject to. Additionally, the taxi industry requests Transportation Network Company drivers be required to display identification similar to the requirement placed on taxi drivers, with which Airport staff agrees.

Potential amendment to Affordable Housing Impact Fee to exclude rental projects of 20 or fewer units

In November 2014, Council adopted a resolution that established an Affordable Housing Impact Fee (AHIF) of $17 per sq. ft. on new market rate apartments in San Jose. In addition to establishing the AHIF, Council directed the Housing Department to research and return to Council to address several questions, pertaining to the potential for pursuing a Commercial Linkage Fee, and whether the AHIF might make certain types of development infeasible.

Council will:

  • Receive answers to questions regarding the potential impacts of AHIF on different projects
  • Provide direction on a resolution to exempt rental developments with fewer than 20 units
  • Provide additional direction to the Housing Department, if desired.

City of Gilroy

Potential agreement with AFSCME 101 including a 4% increase plus salary survey

Closed session discussion regarding tentative deal reached with AFSCME Local 101 that may avert strike; City Manager has agreed to a 4% increase over the term of the contract plus a salary survey of City Employees to evaluate where salaries are as compared to market rate.

Several concerns found relating to Silicon Valley Flex Academy charter renewal petition

The charter for Silicon Valley Flex Academy expires on June 30, 2016. On September 6, 2015, the Charter Schools Office of the Santa Clara County Office of Education received a petition for their renewal. While the petition included required affirmations, staff found several areas of inadequacies in the following areas:

  • The charter is unclear about plans, strategies, and metrics in several areas
  • Staff found several indicators that the school has an unsound educational program
  • Staff found several serious concerns about the school’s long term financial viability

Tahoma Charter School petitions for renewal

The Charter Schools Office of the Santa Clara County Office of Education has received the petition for the renewal of the Summit Public Schools: Tahoma Charter School. This school was approved as a grades 9-12 charter school in 2010 and opened in the fall of 2011. It is located within the East Side Union High School District.

Santa Clara Valley Transportation Authority

 Establishing a process to mitigate small business impacts from Alum Rock/Santa Clara Bus Rapid Transit construction 

The Alum Rock/Santa Clara Bus Rapid Transit (BRT) Project will provide just over seven miles of limited-stop rapid transit service in downtown San José. This 2000 Measure A funded project includes installation of new, bus-only lanes on Alum Rock Avenue between U.S. 101 and I-680.

At its October 1, 2015 meeting, the VTA Board of Directors apologized for the inconvenience and impact to the community and small businesses in the affected area caused by the delay. In overview, the Board pledged to move forward by: (1) enacting a process to institute corrective and preventative measures to return the affected area back to normal as soon as possible; and (2) providing support to those small businesses in the affected area.

Santa Clara Valley Water District

 Declaration of impasse with IFTPE 21 / Professional Managers Association; District to impose contract terms

Staff Recommendation:

  • Approve the last District compensation proposal to the Professional Managers Association
  • Direct the Chief Executive Officer to implement the final middle manager classification and compensation study (new salary schedule, Attachment 1 and 2) effective October 1, 2015.
  • The District Classification and Compensation Study (DCCS) was established and began in 2013.  The last completed classification and compensation study was 18 years ago in 1998.
