Interim ordinance to limit rent increases to 5% & set pass-through provisions

Recommendation: Amend Chapter 17.23 of Title 17 of the San José Municipal Code providing an interim reduction in annual rent increases to 5%, establish a deadline for cost pass-through petition filing under the current Apartment Rent Ordinance, and providing an interim fair return petition process, effective until January 1, 2017 or sixty days after the effective date of an Ordinance amending Chapter 17.23 consistent with Council direction, either by:

(a) Adopting an urgency ordinance adding Part 8 to Chapter 17.23 of Title 17 of the San José Municipal Code; or

(b) Approving an ordinance adding Part 8 to Chapter 17.23 of Title 17 of the San José Municipal Code.

The adoption of an Interim Apartment Rent Ordinance (Interim Ordinance) would provide temporary requirements that owners of apartments under the Apartment Rent Ordinance must follow. These interim provisions include an interim limit on rent increases to 5%, a deadline for filing and award of petitions, a fair return process, procedures and effective date, and the termination date of the interim ordinance. As part of this action, the City Council will determine if the Interim Ordinance is adopted either as (1) an urgency ordinance effective upon adoption or (2) a non-urgency ordinance, which would make it effective 30 days after the second reading.

 Memo from Mayor Liccardo and Council Members Manh Nguyen and Tam Nguyen to establish interim Vietnamese Community Center at Shirawaka,

On March 18, 2016 the Mayor released his March budget message which included $300,000 in proposed funds to identify a site, and commence fundraising for the operation of a Vietnamese American community center.

This memo recommends directing the City Manager to:

  1. Negotiate and execute new lease terms with the Office of Economic Development with the intent to share the space at the Shirakawa Community Center;
  2. Approve the use of a portion of the Shirakawa Community Center for an interim Vietnamese American community center;
  3. Identify additional funding required for the initial operations for the Vietnamese American community center, with the City of San José as the lead operator;
  4. Begin a Request for Qualifications (RFQ) process;
  5. Conduct outreach to gather input on possible services and programs that the community would like to see at the Vietnamese American community center;
  6. Approve donations from various individuals, business or community groups to support the effort;
  7. Develop a fundraising plan for improvements at the Lucretia Avenue location or for construction of a new center as part of the $300,000 identified in the Mayor’s March Budget Message;
  8. Place the item on the May 10, 2016 Council Agenda for action.

Considering changing Performance Measures for Team San Jose

 Recommended action: Approve an addition to the June 27, 2016 Community and Economic Development Committee meeting: Report on Team San José Performance Measures.

City Council expressed interest in improving the current performance measures for Team San Jose. The item was cross-referenced to Council on December 1, 2015, and staff was given direction to:

(1) Work with Team San Jose and the City’s industry advisor (Conventions, Sports and Leisure) to ascertain:

(a) how the City and Team San Jose can better attract a higher proportion of high profile, tech-focused conferences to the San Jose Convention Center; and

(b) how the City can appropriately measure and incentivize Team San Jose to attract high profile, tech-focused conferences to the San Jose Convention Center.

(2) Have a Performance Goals/Incentives discussion with Team San Jose and to report back to the Community and Economic Development Committee in spring 2016.

Staff has had several discussions with Team San Jose about potential modifications to their

performance measures. The Team San Jose board when considering possible new performance

measures, came to the conclusion that more internal discussion was needed.

Staff proposes to return to the CED Committee on June 27, 2016, to review and discuss the

methodology and intent behind the existing performance measures, and return in fall 2016 with

proposed new performance measures.

City of Cupertino

 Initiative submitted for approval of N De Anza Gateway project, incl. 156 hotel rooms

Staff recommends that the Council authorize the City Manager to spend up to $135,000 to retain the necessary economic, environmental, and legal consultants to help prepare the Report and appropriate these funds.

Pursuant to the Elections Code, the City Attorney prepared the official title and summary for the Initiative.

The official title for the measure is: Initiative (1) amending Cupertino’s General Plan requirements for the North De Anza Gateway to increase the existing allocations by 35,000 commercial square feet and 156 hotel rooms, increase the maximum building height from 45 to 58 feet, and remove some development standards; (2) establishing a new ‘Gateway Zoning District’ to allow greater building heights and new permitted uses in certain areas and applying this zoning to the North De Anza Gateway; and (3) requiring conditions of approval for the North De Anza Gateway to include certain community benefits, and setting parking limits.

Consider setting Aug. 15 as date for primary ballot arguments, Aug. 22nd for rebuttals for the Citizens’ Sensible Growth Initiative & any other ballot measures

Recommendation to adopt the draft resolution amending Resolution No. 16-029 to set the date of August 15, 2016 for primary ballot arguments and August 22, 2016 for rebuttal arguments and impartial analyses for all measures that the City Council places on the ballot for the November 2016 election in order to establish a uniform deadline for all measures that the City Council places on the ballot for the November 8, 2016 election.

On March 31, 2016, the City Council ordered that an initiative (referred to by its proponents as the Cupertino Citizens’ Sensible Growth Initiative) be placed on the ballot for the November 8, 2016, general election pursuant to Elections Code section 9215(b) and (c). On the same date, the Council adopted Resolution 16-029, which provided for written arguments regarding the initiative and directed the City Attorney to prepare an impartial analysis for the initiative.

Accordingly, in order to set a uniform date for all primary and rebuttal arguments and impartial analyses for measures appearing on the November 8, 2016 ballot, the City Council would need to change the deadlines established in Resolution 16-029. The City will be contracting with the County Registrar of Voters to conduct the election and the deadlines for arguments and impartial analyses established by the Registrar are the last dates that the City can establish as deadlines for City measures.

City of Milpitas

 Campaign Finance Reform Committee Recs include increase in City Council size to 7 seats tied to Districts

Recommendations from the Campaign Finance Reform Committee include:

  • It was unanimously recommended to increase the size of the city council from 5 to 7 elected members tied to districts (if required by law) with one member elected as mayor.
  • It was unanimously recommended to have a voluntary contribution CAP.
  • It was unanimously recommended a voluntary contribution CAP of $25,000 for mayoral candidates and $20,000 for council candidates and include a Cost of Living Adjustment formula.
  • It was unanimously recommended that registered lobbyists with the City of Milpitas be excluded from contributing to candidates during the election cycle.
  • It was recommended the City Council support Proposition 49 if approved for the state ballot in 2016. (There was one no vote.)
  • It was unanimously recommended that the five (5) largest contributors in Milpitas follow the California Disclosure Act including original funders along with committee name and include a specific font size that is readable on all literature, advertising (including radio and television), web sites, and robo calls.
  • It was recommended to increase the fine from $10 to $25 a day for late filings by any candidate, committees, PACs, etc. in the City of Milpitas. (There was one no vote.)

Council to discuss regional minimum wage study

The City of San Jose is leading the effort to analyze and study a Countywide minimum wage. Several cities in Santa Clara County, including City of Milpitas, agreed to assist and participate in the study effort. As City officials understand it, the study is nearly complete but not yet available at the time of this report. It is anticipated that the preliminary report findings would be released on Friday, April 15, 2016. In January 2016, the statewide minimum wage increased to $10/hour; and the Governor just signed SB 3 which increases the statewide minimum wage to $15/hour on a schedule starting in January 2017 and increasing through January 2023.

The City Council has also considered raising the current contract janitorial minimum wage to $13.00 per hour but had deferred any action until the Countywide minimum wage study was completed. The table (included in the agenda packet) reflects the current contract provisions and the escalation of wages for the city’s contract janitorial services. Escalation per terms of the agreement provides for an increase to $10.75 effective January 1, 2017 (.25/hour more than required by SB 3) and an increase to $13.69 effective January 1, 2018 ($2.69/hour more than required by SB 3). The City Council has a budget study session scheduled on Monday, April 25, 2016.

There are several key decision points to prioritize and discuss, including internal budget requests from all departments as well as the possible escalation of the private janitorial wage increase ahead of the contractual wage increase (reflected in the table included in the agenda packet). To comply with public contracting provisions, any wage increase will require invoking the 30-day cancellation clause with the City’s current janitorial contract vendor and re-issuance of a new Request for Proposal (RFP) with the wage terms as may be directed by City Council.

Development Agreement with Robert Green Co. for development to include 5K sq. ft. hotel

 Recommendation to approve negotiated business terms by and between the City and the developer, the Robert Green Company (RGC), for the development of the Hope Street Lots 4 and 8.

Scope of development includes a hotel on Lot 4—A 180-room Joie De Vivre (JDV) full-service lifestyle hotel featuring at least a three-diamond quality rating per AAA’s scale and 5,000 square feet of meeting space, 7,000 square feet of food and beverage service, and a rooftop hospitality deck. The proposed hotel is five stories and 55’ in height. The hotel will meet LEED Silver® Certification Standards.

Initial poll findings regarding potential local business tax for transportation

Fairbank, Maslin, Maullin, Metz & Associates (FM3) conducted an initial poll of 400 community members during the week of April 14-20 to gauge the level of support on the concept of a potential local business tax to be used for transportation related purposes.

Dave Metz, a principal with FM3 will attend the Monday Council meeting to present an overview of the initial findings and support discussion on the poll results with the Council. The poll results and FM3’s analysis will be distributed at the Council meeting on Monday.

Santa Clara Valley Transportation Authority (VTA)

 Approve the Santa Clara County One Bay Area Grant (OBAG) Cycle 2 Guarantee Program Distribution Formula and Countywide Competitive Complete Streets Project Selection Criteria

 The One Bay Area Grant Program (OBAG) was created by the Metropolitan Transportation Commission (MTC) in May 2012 to better integrate the region’s discretionary federal highway funding program with California’s climate statutes and the Sustainable Communities Strategy (SCS). The VTA Board programmed the initial cycle (OBAG 1) in June 2013.

The MTC Commission is now scheduled to approve final OBAG 2 procedures and guidance in April 2016. OBAG 2 will include FY 2018-2022 Surface Transportation Block Grant Program (STBGP) and Congestion Mitigation and Air Quality (CMAQ) funds. Approve the terms and conditions for the Cerone Request for Qualifications (RFQ), pursuant to VTA’s Joint Development Policy; no labor standards mentioned

Staff proposes to issue a RFQ for a Joint Development opportunity at Cerone Division, located on Zanker Road and SR-237 in North San Jose, CA. In October 2015, staff presented to the Board a general development concept for a potential RFP. Since then, staff has worked to identify issues that would have to be addressed in a joint development project, including relocation of parking and ancillary uses outside the boundaries of the bus yard facility.

The purpose of the RFQ is to solicit submittals of developer capabilities and expertise that can be used to identify a “short list” of approximately three to five developers with the capacity and capability to create the type of joint development envisioned by VTA. By identifying a short-list of pre-qualified developers, Staff expects a more robust competition in the RFP round that will result in the most advantageous possible joint development proposals for VTA.

The terms and conditions in the proposed RFQ include a range of information to be submitted to allow evaluation of developer capabilities and expertise.

No labor-related or job quality standards appear to be included in the RFQ.

 Public hearing on 5-year renewal petition from Bullis Charter School

Chapter petition from Bullis Charter School (BCS) for Los Altos School District seeking a five-year renewal of their charter for the period from July 1, 2017 through June 30, 2022. The charter school will present to the board its strategy to extend to a five-year renewal in order to be able to implement new strategies. Strategy I- We will seek to understand the concept of competency- based learning (which provides students an innovative educational approach with individualized progression of achievement) and evaluate its possible implementation within the current BCS model. Strategy II -Create, practice, and promote a consistent definition of student success in a way that it is clear to and valued by the student, the teacher, the family, and the community at large, and incorporate it into student evaluations. Strategy III -Proactive strategic recruitment that nurtures and then leverages relationships with mission and culture-aligned prospective employees. Strategy IV -Parent volunteerism and engagement is celebrated and understood to be a core Tenet of Bullis Charter School. Cost estimate for new District Office up from $18.5M to $22.3M; rec to consolidate Measure E funds to pay for additional cost

Original projected cost was $18,500,000 and the new estimated cost is $22,300,000.  The increase is due to a significant increased volume of available projects on the market in the last 18th months and the bid pricing is less competitive resulting in higher constructing cost. The recommended solutions are to Consolidate Measure E funds to pay for complete DOB/ETS of renovation.
