Approving authority to purchase property interest in the San Jose Marriott hotel from the former Redevelopment Agency

The Property is currently comprised of a 510-room, 27-story hotel that provides many benefits to the public and the San José downtown economy, not to mention the many jobs provided to service the hotel.  The Real Property Interest is being offered for direct sale by the Successor Agency pursuant to the Redevelopment Dissolution Law and Oversight Board’s Disposition Process.

Acquisition of the Real Property Interest by the County would ensure these benefits are maintained for many years to come.  Just like the Successor Agency, the County would not have any obligation over the management and operations of the hotel, apart from ensuring the hotel owner maintains the property as a first-class hotel.

Approval of this Resolution would give the County Executive the authority to negotiate and sign agreements for the acquisition of a real property interest in the property for a public purpose.  The Real Property Interest requires the property use be maintained as a first-class, convention center hotel.  The Declaration also obligates the hotel owner to make revenue participation payments to the Successor Agency, which would be assumed by the County after acquisition.

The purchase price for the Real Property Interest will not exceed the appraised value of $12,470,000 plus reasonable closing costs.

Reviewing & providing direction on 3 development concepts for 55-acre Civic Center property

On December 4, 2012, the Board of Supervisors authorized the possible lease, sale, joint development or other disposition of County-owned property, and the issuance of requests for proposals or competitive bidding, of approximately 55 acres of County-owned real property in the Civic Center for purposes of public, residential, commercial, industrial and/or cultural use or development.

On December 10, 2013, the Board unanimously approved an ENA with Lowe Enterprises and Gensler Architects relating to the County Civic Center.

On May 19, 2015, the Board expressed support for moving forward to develop a Master Plan based, among other things, on a conceptual plan along the lines of Scenario 3, consolidating all public uses to the area north of Hedding and creating a single block south of Hedding for revenue generating uses.

The subsequently approved Master Development Agreement with Lowe provides that Lowe/Gensler would develop 3-5 alternatives for the planning of the Civic Center (including Sites A, B, C and D). Lowe/Gensler has prepared the attached three master plan concepts for the Board’s review (Attachment). The master plan concepts are categorized as:

  1. Campus Commons
  2. Urban Hub
  3. Neighborhood Connector

Descriptions of each concept are included in the item memo and attachments. The Urban Hub option addresses the need for flexibility and future growth best among the three alternatives because it allows the County possible room for expansion (especially on Sites A and C) while maintaining the option for possible private development at Site D and the possible sale/lease of Site B to VTA.

For each concept:

  • Phase 1 is the Public Safety and Justice cluster at Site A. Phase 1 would also include the streetscape along West Hedding Street from North First Street to San Pedro Street.
  • Phase 2, the Board Chamber, Finance and Government, and Social Services Agency cluster, would be at Sites B, C, and/or D, dependent on the master plan concept.
  • Phase 3 includes any future development for County facilities or private development.

CEQA analysis and evaluation by consultant David J. Powers and Associates will begin after receiving direction from the Board at the November 15th meeting.

Next Steps: Based on Board discussion on November 15th, Lowe/Gensler will prepare a refined Base Scheme plus an Alternate Scheme Master Plan for presentation to the Board in January/February 2017. At this point Anderson Brulé Architects will also present the Public Safety and Justice Service Model, Program and Operational Diagrams. A notice of preparation (NOP) for a draft EIR will also be brought simultaneously to the Board for approval for public notice and distribution.

Next steps on use & planning for County-owned lands 

In this report, the Administration is presenting our current efforts in space and master planning as well as asset development in order to stimulate a Board discussion about what form and dimensions should the County’s participation in real property acquisitions and development activities take in order to satisfy the Board’s expectations of the County’s role.

The Administration provided this report to FGOC at its September 8, 2016 meeting.  Supervisor Chavez had the following questions and comments:

  • In order to meet existing and long-term needs for the business of the County, how do we incorporate real estate costs into our business planning activities, and are there opportunities for the County to generate revenue from those businesses?
  • How can the County plan for long-term growth in our facility needs, including opportunities today to acquire property that, twenty-five years from now, may no longer be available to the County?
  • Rather than limiting our view of County facilities as performing a service function, by evaluating the potential for those assets to provide a return on investment, the County could formalize a process for thoughtful, long-term reinvestment into our facilities and establish a percentage goal of residuals that may go back into the General Fund.
  • The County may benefit from having dedicated staff who, as their sole responsibility, examine investment opportunities in County real estate assets in anticipation of the short- and long-term needs of County departments.

Recommendation to delay $15 by 19 minimum wage, add exemptions

Council will consider staff’s recommendations related to a countywide effort to increase the citywide minimum wage to $15 per hour ahead of the state schedule. Staff recommends:

  1. Delaying the implementation of the studied schedule by one year, starting with an increase to $12 in January 2018, an increase to $13.50 in January 2019, reaching $15 per hour in January 2020 (one year later than the Cities Association recommendation).
  2. Increasing San Jose’s minimum wage to $10.50 in January 2017, for consistency with the state schedule across employers of all sizes.
  3. Adding an exemption for employees in transitional jobs programs.
  4. Changing the CPI index used for annual increases from the U.S. All Cities CPI-W to the San Francisco-Oakland-San Jose Consolidated Metropolitan Statistical Area (CMSA) CPI-W to more accurately account for the cost of living adjustments in this area.
  5. Including an ‘off ramp’ provision with two economic triggers similar to the State of California, providing option to delay scheduled increase to the minimum wage if a severe recession occurs during the ramp up to $15.

Memo from Liccardo, Herrera, Jones, and M. Nguyen requests the following changes to staff recommendations: (a) Move the implementation of $12 to July 1, 2017, $13.50 to July 1, 2018 and $15 to July 1, 2019. (b) Include an exemption for youth (below 18 years of age) in training/education employment programs, limited to 120 days annually per position and per trainee.

Memo from Carrasco, Peralez, Kalra, and Rocha recommends adoption of the Cities Association recommendation to increase the minimum wage to $12 in January 2017 and reach $15 by 2019 with no exemptions and including the following staff recommendations: (1) Changing the CPI index used for annual increases for the U.S. All Cities CPI-W to the San Francisco-Oakland-San Jose Consolidated Metropolitan Statistical Area (CMSA) CPI-W to more accurately account for the cost of living adjustments in the area. (2) Including an ‘off-ramp’ provision with two economic triggers similar to the State of California, providing an option to delay scheduled increase to the minimum wage if a severe recession occurs during the ramp-up top the $15. (b) Direct staff to return to November 29, 2016, with an ordinance to modify the existing minimum wage ordinance according to Council direction.

Memo from Khamis supports staff recommendation to delay the entire studied schedule for minimum wage increases by an additional year, resulting in no change in 2017, an increase to $12 in 2018, and reaching $15 in 2020.

Letter from SVCN supports exemptions for youth and training exemptions.

December 12 Study session for development services fees; incl. proposal to modify/reduce construction taxes

Set a Special Meeting of the City Council to consider the draft Development Services Fee Study and Process Improvement Implementation Action Plan and consultants work with the four development partners for Monday. December 12, 2016, from 1:30 p.m. – 4:30 p.m. in City Council Chambers. The proposed Meeting will allow the consultants and the four development partners (Planning, Public Works, Building and Fire) to present the final report and the proposed implementation action plan.

Council will also receive a briefing on the current structure of City construction taxes and the case for modification. In February 2017, Council will be asked to consider staff’s recommendation to modernize the construction tax, since a current partial suspension for certain industrial uses ends in March. In order to introduce Councilmembers to this issue affecting the cost of development, staff proposes to brief the Council about construction taxes at the end of the Development Services Special Meeting. The briefing will also highlight the critical funding needs and uses of these construction taxes that support the transportation program.

Approve settlement with Sharks Sports & Entertainment of lawsuit over Trammel Crow’s development plans at Diridon

Approve the settlement of Sharks Sports & Entertainment LLC v. City of San José, et al.   Settlement is recommended to avoid further litigation and because settlement terms are reasonable. Upon execution of the Satisfaction Agreement with the City and dismissal of this lawsuit, Trammel Crow will contribute $4 million dollars to the City to be restricted for the acquisition of certain properties to the north of the SAP Center for the use of public parking. City will make good faith efforts to purchase these properties with the provided funds. If the City is able to acquire all the properties, the City will also lease certain adjoining SSE properties for $1 /month and construct a surface parking lot that will be operated by SSE for the purposes of public parking. It is important to note that the City Council had previously set aside funds for additional parking at the SAP Center in the General Purpose Parking Fund that can be used for the construction of a surface lot.

City of Milpitas

Approving franchise agreement with Garden City Sanitation for solid waste collection services

Staff are recommending that Council provide direction on, approve, and authorize the City Manager to execute a solid waste collection franchise agreement with Garden City Sanitation (dba Milpitas Sanitation), subject to final review and incorporation of non-substantive changes by the City Manager and City Attorney.

The City’s current contract for solid waste collection expires in September 2017. The City conducted a two part procurement process, separating disposal and collection contract award. In response to the City’s Request for Proposals (RFP), two companies submitted disposal proposal and six companies submitted solid waste collection and materials processing proposals. After a rigorous selection process and negotiation with the top two proposers, staff recommends that Garden City be selected to provide solid waste collection services for the City of Milpitas for the below reasons:

  • Direct attention and involvement to the Milpitas contract from company ownership and higher levels of management and supervisory oversight, which will likely result in higher service quality
  • Working with a Company that is primarily focused on diverting material from landfill, which is consistent with direction of State Legislature and CalRecycle.
  • Opportunity to participate in Sunnyvale’s SmaRT station, which is a publicly-owned, transparent facility that can be used for handling materials collected in Milpitas. This could offer the City more control over future costs and availability of viable location for solid waste management.

Staff recommends that Council direct staff to finalize an Agreement with Garden City Sanitation and provide input on preferred scope of services – i.e. whether to include a 20 gallon cart and whether debris box system will be exclusive or non-exclusive. Staff further recommends that Council direct staff to report back to Council with a summary of the final agreement, pricing, and rates.

City of Santa Clara City

Approving appointment of a 3-member Ad Hoc Subcommittee to advise on selection of a Stadium Oversight Manager

The City Manager is recommending that Council approve the creation of a Stadium Authority Ad Hoc Sub Committee to provide input on the selection process of a Stadium Oversight Manager classification. This new classification will serve as the Stadium Authority’s representative responsible for the oversight of the Management Agreement with the Forty Niners Stadium Management Company, LLC (ManCo), as well as other stadium-related agreements. In addition this position will have the responsibility to keep the City Manager/Stadium Authority Executive Director and City Council/ Stadium Authority informed on NFL and/or non-NFL related events held at the Stadium.

Because the City Manager has the responsibility to appoint and remove all officers and employees of the City, with the exception of those provided by the Charter, such as the City Attorney who reports directly to the City Council, the Stadium Authority’s Ad Hoc Sub Committee’s role will be to provide input to the City Manager on the selection process of the Stadium Oversight Manager. The Stadium Authority Ad Hoc Sub Committee will dissolve once the selection process has been completed in accordance with the Brown Act.
