Lawsuit Filed Against City of San Jose’s Review of Toxic Site Planned for Development

Last week, labor organizations and local residents filed a lawsuit in Santa Clara County Superior Court to prevent the City of San Jose from planning development of a site, contaminated with cancer-causing chemicalswithout evaluating the public and worker health risks and safety and environmental impacts.

The Santa Clara County Department of Environmental Health found that the project site, located in downtown San Jose at the corner of 4th and St. John streets, has benzene, a known human carcinogen, which can cause developmental and neurological problems. In a letter from the Department of Environmental Health, it states that, “residual contamination in soil and groundwater remains at the site that could pose an unacceptable risk under certain site development activities such as grading, excavation, or the installation of water wells.”
